RENTAL AGREEMENT
Range — Firearms Training
THIS RENTAL AGREEMENT, heremafter referred to as "Agreement ", made and entered into
between the CITY OF BREMERTON, whose address is 345 Sixth Street, Surte 600, Bremerton,
WA 98337, hereinafter referred to as "Landlord" and Tacoma Police SWAT, heremafter
referred to as "Tenant"
NOW, THEREFORE, m consideration of the terms, condrtions, covenants and performances
contamed herein, IT IS MUTUALLY AGREED AS FOLLOWS
DESCitIPTION OF P1tEMISES The Landlord hereby leases to the Tenant the
followmg described premises for up to thirty (30) days m any calendar year
FIRING RANGE Located '/4 mile north of the Gold Mountam Golf Course on
the Old Belfair Highway, 6581 West Old Valley Road, Bremerton, Washmgton
98312
Days of use shall be scheduled tlurty (30) days m advance and will be accomodated on a first
scheduled basis
2 TERM This agreement shall become effective on January 1, 2012 for up to one year,
and endmg on December 31, 2012 This agreement shall automatically be renewed on a
calendar year basis unless written nohce of termmation is grven by erther party by the
proceedmg month of any such year
3 RENTAL RATE The Tenant shall pay rent to the Landlord for the premises at the
followmg rate Seventy-Five Dollars and No Cents ($75 00) per day, m advance
4 EXPENSES Tenant shall supply all weapons, ammumtion, targets and other supplies
�- used m the target exercise
5 MAINTENANCE AND REPAIR The Landlord shall, unless herem specified to the
contrary, maintam the premises m good repair and tenant able condrtion during the
contmuance of this agreement, except m case of damage arismg from the negligence of
the Tenant's agents or emloyees For the purposes of so maintainng the premises, the
owner reserves the nght, at reasonable times, to enter and inspect the premises and to
make any necessary repairs to the buidlmg Tenant shall clean un all garbage and
debris after use
6 TERMINATION This agreement may be termmated by either party, wrthout cause, by
givmg wntten notice of not less than tlurty (30) days pnor to the effective date of
termmation Pro-rata refunds for the remaimng pre-paid rental term shall be refunded to
Tenant should either party mitiate termmation
7. RANGE SUPERVISION: Tenant shall provide and require the presence of a qualified
range officer at all times during which the tenant's personnel are using the premises To
assure safe operations, the range officer shall have full authority and responsibility to

direct the activities of those usmg the range and shall halt any activity found to be unduly
hazardous
8 HOLD HARMLESS It is understood and agreed that this agreement is solely for the
benefit of the parties hereto and gives no nght to any other party No �omt venture or
partnerslup is formed as a result of this agreement Each party hereto agrees to be
responsible for its own acts or omissions, or those of rts officers, agents, or employees,
and agrees to save, indemnify, defend, and hold othe other party harmless from any such
liability In the case of negligence of both the Tenant and the Landlord, any damages
allowed shall be levied I proportion to the percentage of negligence attnbutable to each
party, and each party shall have the nght to seek contnbution from the other party m
proportion to the percentage of negligence attributable to the other party
