immediately, so it would be impossible for the rnsurer to give you the notce you request State law also granfs the insurer the rght to cancel for reasons such as nonpayment with less notice than you require • For the reason ust cited, if our agency was to issue a certificate that provrdes the cancellation notce you request, we would do so with the fuli knawledge that it wouid be impossible to actually gve tha# amount of notice under certain circumstances As such, the certifcate could be alleged to constitute a misrepresentaton or fraud which could subect our agency and staff to serrous civil and cnminal penaities • If a certificate purports to provide a policy nght drfFerent from that provided by the policy itself, then the certificate effectively purports to be a poficy farm Palicy forms must be filed and approved by our state department of msurance Use of nonfiled policy forms is illegal and could resu(t in legal sanctions distinct from the assertion that the certicate is fraudulent • Under the ACORD Corporation's licensing agreement, the prior editions of superseded forms can be used for one year from the tme the new forms are mtroduced Beginntng in September 2010, this is another reason we cannot use an older edition of the ACORD 25 Domg so would violate ACORD's licensing agreement and, as a copynghted document, federal copyright law • Likewise, we are unable to modify the new certificate to add a notce of cancellaton ACORD forms are designed to be completed, not altered ACORD's Forms Instruction Guide says that a certificate should not be used "To waive rights To quofe wording from a contract To quote any wordrng which amends a policy unless the policy itself has been amended " In addtion, our insurance company contracts only allow us to ssue unaltered ACRD forms • We are often asked to issue propnetary certificates provided by the certifrcate requestor Again, our insurance company contracts only alfow us ta issue unaltered ACORD forms Many proprietary certificates mclude broad, vague or ambiguous language that may or may not be mcompliance with state laws, regulations, and insurance department drrectives Therefore, we cannot issue any proprietary certificates We appreciate your understandmg of the legal restnctions on our abdty to fully comply with your request Ths page has been left blank ntentionally Hokkaido Dnlling Inc 22UUVTA2250 . _.Y:__'. :..w l.,_-.:.
