RCW 35 77 010 outlines requirements associated with development and
adoption of the comprehensive six year transportation program (TIP ) The
statute requires the TIP to be filed with the secretary of transportation prior to

delayed TIP adoption was discussed at the September 23 Peninsula Regional
Transportation Planning Organization (PRTPO) meeting, a deadline of adoption
and transmittal of the TIP by October 24 was identified for incorporation into the
initial 2012 State Transportation Improvement Plan (STIP) Submittal of the TIP
to WSDOT after that date could delay incorporation into the STIP until after
January 2012

COUNCIL SUMMARY
CONCRETE BARRIER INSTALLATION
ON NORTH EDGE OF SIDEWALK
Summary
With the replacement of the Manette Bridge by the Washington State Department of
Transportation ( WSDOT), the City initiated the concept of a concrete barrier being
incorporated on the new bridge to separate the new sidewalk from the roadway This
concept was not included with the final plans due to concerns for cost and lack of
warrants for installation
Late last year, WSDOT approached the City with proposed architectural changes on
various issues including the radius of bulb -outs, concrete finish and forming, and railing
In the discussions, the City reintroduced the inclusion of the proposed concrete barrier
All of the revisions resulted in cost and time savings to the project with the exception of
the new concrete barrier
In a March 15, 2011 Manette Community Meeting, representatives from WSDOT, City
staff, elected officials , and community members met for an update to the project and
discuss the revisions to the bridge design At this meeting, the City accepted the design
changes in exchange for inclusion of the concrete barrier with City payment to WSDOT
at a not to exceed amount of $75,000
Fiscal Summary
The City is responsible for $75,000 of the total cost of the new concrete barrier This
cost would be from the Arterial Street Fund and has been committed for this effort

Re Manette Bridge Rail Pedestrian and Bicycle Safety Provisions
Dear Kevin
This letter confirms the understanding between the City of Bremerton and the Washington State
Department of Transportation ( WSDOT) pertaining to the proposed changes to the planned
railing as well as agreement on the concepts for the added rail These changes were presented
by Amy Revis, WSDOT Project Engineer, at a meeting on March 15, 2011 in the Manette Senior
Center in Bremerton
The City of Bremerton agrees to fund its portion of the costs of the changes at an amount less
than or equal to $75,000 Due to the fact that this item was not budgeted by the City, the City
requests that all attempts should be made to reduce the City's portion of these costs as much
as possible The City of Bremerton also requests the opportunity to review construction plans
for the concepts in the attached WSDOT documents prior to proceeding with the implementation
of the proposed changes
The City greatly appreciates the cooperation with which WSDOT continues to carry out the
Manette Bridge replacement project
Sincerely,
Vincent Akhimie

Re Bremerton Ice Center LLC
Our File No. 20280 -173 (3)
Dear Mr Birkenthal
This office represents the Bremerton Ice Center LLC (`BIC "), the owner and operator of the
Bremerton Ice Center
The BIC and the City of Bremerton are parties to a Concession Agreement, which is essentially a
long term land lease of the property where the ice center is located The Concession Agreement
currently does not allow the sale or consumption of alcohol on the property We are requesting that
the Concession Agreement be amended (along with amending and carving out an exception in
BMC 13 04 140, similar to Pendergast Regional Park) to allow for the sale and consumption of beer
and wine on the property
The Bremerton Ice Center is an ice skating facility that serves a diverse group of users from toddlers
to seniors The ice center, like many recreational facilities, faces a challenge in profitability due to
the cxpenses required to operate the facility Given the current downturn in economic conditions
across the country, the ice center is seeking new ways to bring in revenue to ensure that the ice
center can maintain a quality facility that the Bremerton and Kitsap communities can use and enjoy
The ice center is the host to an adult hockey league, youth hockey league, Bremerton Figure Skating
Club, and numerous private users The Bremerton Ice Center also provides public skating sessions,
learn to skate programs, hockey camps and clinics and figure skating competitions The Bremerton
Ice Center is the home to the West Sound Warriors Junior Hockey team which plays 25 home
games annually, with several hundred fans in attendance The ice center currently hosts 6 hockey
tournaments per year which brings approximately 1,350 families to Bremerton every year from
across the Pacific Northwest and Canada
The Bftmerton Ice Center wants to expand its concession and food service, to include beer and
wmt in an effort to increase revenue Beer and wine service is an important component and

revenue supplement from a segment of the users of the ice center The ice center has been diligent
in attempting to control its overhead and seeking out new revenue opportunities. The ability to serve
beer and wine will allow the ice center to expand revenue and attract additional users via private
functions.
It is the intent of the ice center that the alcohol service would occur when the audience and user
group is appropriate, such as during adult hockey league It would be a controlled and responsible
distribution for specific user groups and tunes The Bremerton Ice Center is not looking to be a
neighborhood bar or tavern.
The ice center has a full- service kitchen and preparation area that allows for concessions and
catering for private parties and functions Meeting rooms are available should users want more
privacy for their parties or functions Although the ice center is generally open to the public, the ice
center does sell private tune where a busmess/family gathering may rent the facility, and in those
instances, the ice center is closers to the general public The ability to serve alcohol will allow the
ice arena to sell use of the ice arena for such functions, and keep them from otherwise going
elsewhere
The mission of the Bremerton Ice Center is to provide a safe and family friendly facility where users
of all ages can come and enjoy all that it has to offer The ice center seeks only to enhance its
opportunities and attract responsible business to its facility I hope that you see the positive impact
this will have on ensuring the Bremerton Ice Center can sustain itself financially and may continue
to attract new business and visitors to Bremerton.

REGULAR BUSINESS MEETING
Minutes of September 27, 2011
Attendance: Terry Boyle, Joan Dmgfield, Robert Dollar, John Larsen and Christopher Warthen
Absent: Richard Nerf and Sunny Wheeler
Staff: Wyn Birkenthal, Tom Cressman and Jeff Elevado
I. Meeting Called to Order at 6 03 p in by Commissioner Larson
H. Approval of Minutes — June 28, 2011. M/S /C/U (Wheeler/ Warthen)
III. Public Comment: None
IV. Business Items:
1. Bremerton Ice Center's request to modify agreement to include alcohol sales ( Birkenthal) .
If the City authorizes the sale of alcohol at the Center, Mr Birkenthal reported that a change
must be made to the concession agreement between the City and the Bremerton Ice Center Since the
Federal government gifted the land that the Center is on, the National Park Service must approve any
alterations to the current concession agreement BMC 13 04 must also be amended as the current code
only allows alcohol sales at the concession area in the Olympic Soccer & Sports Center and at the
Harborside Park Ms Wheeler recused herself in these discussions as a Commission member due to her
employment at the Ice Center, but may comment as a citizen
Tracy Digiovanni, an attorney representing the Bremerton Ice Center, explained that the Center
is exploring ways to increase its revenue to support its operating budget She has reviewed OSSC's
alcohol sales policy and understands that there hasn't been any negative impact at that Center Derek
Donald general manager for B I C , explained that they are facing the same challenges as other
recreation centers in this economy They propose to sell wine and beer during special venues in their
lobby They believe they can control the environment so that it will not have a negative impact to the
BIC If approved, they will obtain an insurance rider to cover liability
The Commission recommended changing the BMC and concession agreement as modeled after
the Pendergast and Harborside agreements to include the sale of alcohol M/S /C (DingfieldBoyle)
In Favor of the Motion Boyle, Dingfield, Dollar, Larson, Nerf, Warthen Abstained Wheeler
2. Discussion of a no smoking policy (BMC change) for portions of City parks (Birkenthal).
Many cities have implemented some form of a no smoking ordinance in outdoor parks, while
some cities have banned smoking within a few feet from a developed site
Questions /comments from Commission members Is there a potential for legal problems for
those smokers with an addiction? New York City argued the issue and prevailed May be
challenging as the City has other health issues Has the City's Legal Department commented on this?
They haven't as it is in the discussion stage If the Commission has any questions or issues, they can be
consulted If an ordinance is passed, it will become an enforcement issue It may create a sense of
community for citizens to self - patrol Some citizens who smoke will honor the signs If the
Commission considers the issue for health reasons, they should consider grills More patrons are using
gas grills Should we consider designating smoking areas instead of banning smoking in our parks?
After some discussion, Mr Birkenthal asked the Commission if they would like to implement a
policy if the department had to decrease other operations (less watering at a park or cut a recreation
program) in the amount of $3,000 to $5,000 for new signage Since the idea of a no smoking ordinance
was suggested by the mayor and if it were to pass, they would like to see another source of funds be
used for expenses other than from the Parks Department
The Commission requested the department to return with an opinion from the Legal Department
regarding risk management issues
3. Memorial Status Update (Birkenthal).
The Design Committee recently designed two renderings that included elements recommended
during a public workshop The first design features less hardscape and less cost in scope, and the
second design features more passive and artistic elements The Committee is scheduled to meet later in
P &R Commission — 08/23/11
the week to discuss the differences in the designs
V. Staff Report:
Upcoming Events and Programs

Subject: Item on tonight's study session re beer /wine at the ice arena,
Hi Carol and Lon,
I am wnthng you from my personal email as I wanted to comment on the matter of the Ice
Arena's beer and wine permit which the council will be discussing tonight at its study session I
live in the city -in Carol's distnct -and I am firmly against the arena selling beer /wme as the
YMCA is right up the street Anyone leaving the ice arena (in whatever state of sobriety) would
be required, by the fact that the ice arena is south of the Y on a northbound one -way street, to
drive past the Y, which is a huge draw for kids of all ages. Plus, most of the parking for the Y
obliges users to get near or cross this same one -way street, Homer Jones Dnve
I believe it is a danger to have a locale selling beer /wine so close to the Y, not to mention so
close to the two child care facilities associated with the Y (one m the Y Annex and one further
up the street), both also north of the arena on Homer Jones Dnve
The exemptions the council has granted for Pendergast and Harborside do not appear comparable
to me, in the former, there is nothing else out there except for the Pendergast facility, and in the
latter, the Harborside Fountain Park is m the middle of a commercial district with many other
bars nearby
I have been a member of the Y for several years and I use the Y almost daily, as does my
child, and I would be very nervous about having what amounts to a bar so close to this family
facility If the arena wants to get into the bar business, it should locate in the appropriately zoned
commerical area and away from the community treasure that the Y is for Bremerton
Thank you

SUBJECT: Amendment to the Concession Study Session Date Oct 12 2011
Agreement with the Bremerton Ice Arena Inc COUNCIL MEETING Date Oct 1 § ffi 2011
related to the sale of beer and wine Department Parks and Recreation
Presenter Wyn Birkenthal
Phone 473 -5752
SUMMARY: On May 13 2003 the City entered into a concession agreement for the construction
and operation of an ice arena in Eastpark The arena has served the public with a variety of youth
and adult skating programs including figure skating, hockey, open public skating sessions and senior
skating programs The owners of the Ice Arena have requested the ability to sell beer and wine under
certain conditions as a revenue enhancement to the facility and as a convenience to its adult
customers
This proposed amendment to the concession agreement changes section 4 12 Incidental Uses to
remove the words "Concessionaire agrees that no alcohol will be sold or consumed on the
premises " Should the amendment pass it is subject to review and approval by the National Park
Service The Ice Arena's insurance certificate would be adjusted to provide coverage as
recommended by the City's Risk Manager

Dear Mayor Lent and Members of Bremerton City Council
We were troubled to read in the 12 October Kitsap Sun that the Council may agree to the proposal
to allow beer and wine sales at the Bremerton Ice Arena
The Bremerton Ice Arena is not only a place where children gather, but is next to another facility, the
YMCA, which also caters to children Children and alcohol are not a good mix
We were sad to see the Council approve the sale of alcohol at the Pendergast Center Serious
athletes have always known that the use of alcohol does nothing to contribute to their success
as athletes When alcohol is actually served at an athletic facility, this sends a wrong message
to those aspiring athletes about the mixing of alcohol and sports
Ice skating is a sport where the sharp blades of the skates can cause serious injury An English
hospital, a number of years ago, did a study of accidents at a local ice rink after they began to
sell alcoholic beverages on site Out of the number of serious injuries, the majority were documented
as alcohol- related The hospital recommended that the ice rink stop selling alcohol because
it was very clear to them that alcohol and ice skating don't mix
Children need some areas where they can feel safe Sadly, many of their homes are now being
destroyed by the use and abuse of alcohol (and other drugs) When public officials
actually promote its use, we are ignoring this reality that children from these homes know all
too well. that alcohol and some adults aren't a good mix
We understand that the sale of beer and wine has to do with increasing revenue at the
Bremerton Ice Arena We also understand that money is a concern in these economic
down times. However, we also know that God honors us when we do right He especially
cares about children, and is counting on us to protect them and be good role models for them

The Food and Drug Administration (FDA) recognizes four major hazard classes (I to IV) of lasers, including three
