City Legal Description Attachments 01 -05 -06 Letter to Jim Roda on City legal description doc Thanks for your time today, believe we have traction and getting a good grip on the issue Okay, the way I understand it • There are two separate issues here The first are the "county islands" within City limits where the folks have always thought they were part of the City, and two, getting the perimeter description approved by commissioners /council in ordinance /resolution • We have a problem with how the "county islands" will be dealt with Bylaw, we are required to seek separate annexations for each area, and to notify the private property owners, go through the public hearing process, etc However, when Ken returns from vacation, he will research with MSRC, Washington Association of Cities, etc, to see how other City's have handled this, as we can not be unique in this regard, and see if there is not some method for putting all this into one pot • Those islands involving right of way will simplify need to be agreed upon between us and the County, and can be included into the City legal and accepted by Council The ordinance will be referenced as a correction document to the original annexation descriptions Attached is the rough draft of the letter to the County with the corrections I will work on getting a better exhibit map, and will probably be amending exhibits A, B and C a little as I go back through the legals Please check the first two pages of the letter and let me know if you see any corrections or problems 9 7/21/2006 PUBLIC WORKS & UT/LMES Engineering Division Tel 360-473 -5270 Fax 360- 473 -5398 3027 Olympus Dnve Bremerton, WA 98310 24 July 2006 Jim Roda Kitsap County Public Works 614 Division St, MS -26 Port Orchard, WA 98366 Re Comprehensive City of Bremerton Legal Description Dear Jim, The City of Bremerton requests the County to review and comment on the attached legal which delineates the City limits with a meets and bounds description We believe this to be a mutual benefit to both our organizations, as currently, the only method of determining the City limits is by retracing the various annexation descriptions The City of Charleston was incorporated in August of 1893, with the City of Bremerton being incorporated in October of 1901, and the two cities consolidating in May of 1927 The City of Charleston first annexed property from Kitsap County in June of 1904 Since that time, there have been 110 annexations of property from Kitsap County to the combined Cities With over a hundred years of annexation descriptions being written by various persons (and their respective philosophies regarding legal descriptions), inherently, there are hiatuses, overlaps and discrepancies between the annexations As an attachment to the legal description, a compilation of the discrepancies along the boundary is also provided as "Exhibit A" Several of the more significant discrepancies between the annexations internal to the current City limits are noted in "Exhibit B" Our intent in this endeavor is to have a legal description that entirely encompasses the City limits and provides a clear depiction of where the dividing line between the City and County lies, that we both agree to However, in addition, there are other discrepancies along the boundary of the description which are not corrected by the legal description, as we felt these went beyond the intent of the original annexations and our power to correct These discrepancies are attached in a list as "Exhibit B" and are included for future consideration We appreciate your time in this matter, and would appreciate hearing from you as soon as possible as to the timeframe for such a review Our hope is that once our r departments agree on the legal description, that our respective Council /Commissioners would adopt this description by ordinance shortly there after Please feel free to contact Gunnar Fndriksson at 360 473 2354 if you have any questions or require additional information Sincerely, Phil Williams Director of Public Works and Utilities Cc Bremerton City Council Michael C Mecham P E, City Engineer Luke Korpi P E, Managing Engineer Paula Johnston, City Clerk Ken Bagwell, Assistant City Attorney Andrea Spencer, DCD Planning Manager JoAnn Vidinhar, DCD Development Manager File EXHIBIT A • Annexation 1564 calls to westerly right of way of r Avenue Annexation 1569 calls to centerline of Perry Avenue, leaving the westerly half of the right of way in County jurisdiction • Annexation 1564 calls to southerly margin of hendan Road Annexation 3375 and 2641 call to centerline of Sheridan Road, leaving the southerly half of the right of way in County jurisdiction, and the annexations are non -
