SUMMARY: The City is rescinding the vacation approved on October 15, 2008 by Ordinance No
5061, due to conditions of the vacation not being met The vacation was approved with two
conditions Conveyance of the new right -of -way to the City and a Performance Bond for the new
street improvements Applicant was notified in October 2010 that the City is proceeding to repeal the
Ordinance and that a new application and approval through City Council will be required for any
future vacation of the alley and future development
