A RESOLUTION of the City Council of the City of
Bremerton, Washington, approving and authorizing a sole source
contract for the purchase of a WEMCO Grit Classifier for the
Westside WWTP.
WHEREAS, RCW39.04.280 provides exemptions to the competitive bidding
requirements of municipalities under certain circumstances including when purchases are clearly
and legitimately limited to a single source of supply, and
WHEREAS, the existing WEMCO Grit Classifier needs to be replaced by a unit
manufactured by the same company, due to area and piping Constraints) "']; and
WHEREAS, to install any other unit into this area would require renovation to the
room, including drain pipes, overhead piping and concrete removal and installation, adding
additional costs, and
WHEREAS, the City Council desires to waive the bidding requirement and
authorize sole source purchase of a WEMCO Grit Classifier for the Westside WWTP from
APSCO; NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF BREMERTON, WASHINGTON,
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The recitals set forth above are hereby incorporated as if set forth
herein in full.
SECTION 2. Competitive bidding requirements are hereby waived and are not
required for securing contracts for materials, goods, equipment and services necessary for the
purchase of a WEMCO Grit Classifier for the Westside WWTP referenced in this resolution.
SECTION 3. The Public Works Department is authorized to negotiate a
purchase price with APSCO for the purchase of a WEMCO Grit Classifier.
SECTION 4. That the Mayor is hereby authorized to sign a contract with
APSCO for the purchase of a WEMCO Grit Classifier for the Westside WWTP referenced in this
resolution.
SECTION S. SeverabiliN. If any one or more sections, subsections, or sentences
of this Resolution are held to be unconstitutional or invalid, such decision shall not affect the validity
of the remaining portion of this Resolution and the same shall remain in full force and effect.

SECTION 6. Effective Date. This Resolution shall take effect and be in force
immediately upon its passage.
