SUMMARY: The proposed agreement replaces the current concession agreement between the City
and the YMCA for use of the 3.1 acre land parcel upon which the YMCA facility has been located
since 1984. The Agreement extends the YMCA's term of use for the property and incorporates the
management, maintenance and operation of the City's pool approved by Council during its September
lst meeting. The property upon which the YMCA facility is situated is subject to the City's Park
Protection Ordinance Chapter 13.12 BMC. Although the agreement and its terms are not drafted as a
lease but as a concession, staff is recommending that its approval be processed under this code with
two public hearings before final approval.

RECOMMENDED MOTION: Move to enter into the Concession Agreement with Pierce-Kitsap
YMCA and authorize the Mayor to finalize and execute the Agreement with substantially the same
terms and conditions as presented.
