GRANT OF EASEMENT
AMENDMENT NUMBER ONE (1)
THIS INDENTURE, made the ��, day of , 2010 between the
United States of America, herein called the Govemment, acting through the Department
of . the Navy, and City of Bremerton, a Washington municipal corporation of Kitsap
County, State of Washington.callEd the Grantee.
WHEREAS, the Government owns that certain real property identified as the Naval
Base Kitsap at Bremerton, WA, hereinafter called the Facility; and
WHEREAS, the Government granted Grant of Easement Number
N4425506RPOOT07 to Grantee on June 20, 2006, and
WHEREAS, the Grantee has requested an amendment of this grant of easement to
include the construction, installation, operation, maintenance, repair, and replacement
of surface improvements consistent with the creation and operation of the Bremerton
Memorial Plaza and in support and furtherance of providing vehicular stand off along
the perimeter of the amended easement as illustrated in attached site Plan A and
Photos A-H attached and made a part hereof.
WHEREAS, the Grantee shall maintain or replace in kind as needed the vehicle
barriers that are in place when this easement is recorded. Future modifications will not
encroach on this "barrier line" without approval of the Govemment. The maintenance
vehicle access gate will be kept closed and locked except for brief periods of authorized
entry/exit.
WHEREAS, the Grantee will maintain a strip of property running 20 feet in width
from the Government's Security Fence that comprises a portion of the Govemment's
Security Buffer Zone within the amended easement area. This Security Buffer Zone
may be used exclusively for landscaping purposes. Shrubbery, grass and similar
ground cover will be maintained at a height not exceeding eight inches. Trees, bushes
and similar plants that will exceed eight inches will be approved on a case basis by
Puget Sound Naval Shipyard Secur�ty Office. In general trees and bushes with trunks
and low foliage large enough to provide concealment of people will not be authorized.
� Grantee shall immediately trim any plant back to the 8" height restriction. Approved
landscape trees are illustrated in Photo E.
WHEREAS, the Secretary of the Navy has found that the grant of such easement on
the terms and conditions hereinafter stated is not incompatible with the public interest.
NOW THEREFORE, this indenture witnesseth that, in consideration of mutual
benefits accruing to the parties the Govemment, pursuant to the authority of 10 U.S.C.
2668, hereby amends to enlarge the easement area to include all surface improvements
of the proposed Bremerton Memorial Plaza, limited improvement over the Security
Buffer Zone, and requirements securing a portion of the perimeter of the amended
easement area for vehicular standoff; such amended easement being on that portion of
the Facility hereinafter called the Premises, and described as follows:
