BY MCKENZIE/COGEAN AVENUES AND 12 STREET/SHELDON BOULEVARD ENGINEERING STAFF REPORT CITY COUNCIL HEARING DATE: May 21, 2008 PREPARED BY: Gunnar Fridriksson SUMMARY Applicant: Tiferet LLC 1702 N. 45 Street Seattle, WA 98103 Location: Alley running north-south starting on Sheldon Boulevard and running approximately 135 feet south towards 12 Street, bounded by McKenzie and Cogean Avenues. BACKGROUND The applicant has petitioned the City of Bremerton to vacate approximately 135 feet of alley for a future development which will encompass over half of the area of the block. The southerly portion of the alley was dedicated with the Plat of Park Place Addition (Vol. 3, of the book of plats Pg. 30) in February of 1908, and the northerly portion is owned by the City in fee title. The City excluded it out of a deed to K. Wik in October of 1937 after purchasing the adjacent parent parcel from Kitsap County in September of 1929. No roadway has ever been constructed in the portion to be vacated, and the remainder of the alley has a dirt driveway which services the adjacent property owners to the south within the plat. Topography does not support roadway construction to complete the alley to Sheldon Boulevard due to the narrow right of way and slopes. RIGHT OF WAY CONDITIONS • Functional Classification Local Access • Existing R-O-W Width 14 feet • Proposed R-O-W Width N/A • Pavement Width None • Surface Type Vegetation • Curb and Gutter None • Sidewalks None May 2008 Portion of Sheldon Boulevard Page 1 of 5 HEARING CONSIDERATIONS BMC 11.20.120 sets forth issues that the City Council needs to determine at the conclusion of the Vacation Hearing. These issues and the staff position are: 1. Whether the street, alley or portion thereof is no longer required for public use and vacation of the described portion will better serve the public good. Staff Position: This portion of the alley is not required for public use. 2. Whether the vacation is consistent with the City Comprehensive Plan. Staff Position: The proposed vacation does not conflict with the Comprehensive Plan. 3. Whether continued use of the proposed vacation as a public way is not of such public benefit as to justify the costs of maintenance. Staff Position: Vacating this unimproved right-of-way will reduce the City's maintenance responsibility in this area. 4. Whether substitution of a new and different thoroughfare would be more useful to the public. . Staff Position: No other thoroughfare would improve circulation in this area. 5. Whether conditions may so change in the future as to provide a greater public use or need than presently exists. Staff Position: There is no anticipated future public use. 6. Whether objections to the proposed vacation are made by owners of private property abutting the same. Staff Position: No objections have been received from any abutting property owners to date May 2008 Portion of Sheldon Boulevard Page 2 of 5 SHORELINE ACCESS This portion of right-of-way does not provide shoreline access. UTILITIES No public utility is located within the vacation area. All private utilities were contacted and an easement for Puget Sound Energy and Cascade Gas will need to be retained. SUFFICIENCY OF SIGNATURES , The request for the vacation was made by 75% of the owners abutting the property to be vacated. COMPENSATION The portion to be vacated is a Class I right-of-way as defined in Ordinance 4664 and is owned in fee title by the City of Bremerton. The City purchased the parent parcel in 1927, but no public funds have been expended providing improvements. Total square footage of the vacation is 1,806 square feet which full compensation would be due. However, in light of the future development the property owner has already dedicated additional right of way to the City along Sheldon Boulevard (Kitsap County Auditor Recording No. 200711070172). Total to date dedicated is 1,244 square feet, leaving 547 square feet to be compensated for. Using the adjacent properties Kitsap County Assessor's data, the approximate square foot cost of property in this area is $9.62 per square foot for a value due of $5,262. STAFF RECOMMENDATION City Attorney, Police, Fire, Engineering and Community Development staff notes no objections to the proposal. Staff recommends that this Street Vacation be approved as requested. BACKGROUND The applicant has petitioned the City of Bremerton to vacate approximately 150 feet of alley for a future development which will encompass over half of the area of the block. RIGHT OF WAY CONDITIONS • Functional Classification Local Access • Existing R-O-W Width 14 feet • Proposed R-O-W Width N/A • Pavement Width None • SurFace Type Vegetation • Curb and Gutter None • Sidewalks None February 2008 Portion of Sheldon Boulevard Page 1 of 5 HEARING CONSIDERATIONS BMC 11.20.120 sets forth issues that the City Council needs to determine at the conclusion of the Vacation Hearing. Staff Position: No objections have been received from any abutting property owners to date February 2008 Portion of Sheldon Boulevard Page 2 of 5 SHORELINE ACCESS This portion of right-of-way does not provide shoreline access. UTILITIES No public utility is located within the vacation area. All private utilities were contacted and an easement for Puget Sound Energy and Cascade Gas will need to be retained. SUFFICIENCY OF SIGNATURES The request for the vacation was made by 75% of the owners abutting the property to be vacated. COMPENSATION The portion to be vacated is a Class I right-of-way as defined in Ordinance 4664 and is owned in fee title by the City of Bremerton. The City purchased the parent parcel in 1927, but no public funds have been expended providing improvements. Total square footage of the vacation is 2,016 square feet which full compensation would be due. However, in light of the future development the property owner has already dedicated additional right of way to the City along Sheldon Boulevard (Kitsap County Auditor Recording No. 200711070172). Total to date dedicated is 1,244 square feet, leaving 772 square feet to be compensated for. Using the adjacent properties Kitsap County Assessor's data, the approximate square foot cost of property in this area is $9.62 per square foot for a value due of $7,430. STAFF RECOMMENDATION City Attorney, Police, Fire, Engineering and Community Development staff notes no objections to the proposal. Staff recommends that this Street Vacation be approved as requested.
