A RESOLUTION of the City Council of the City of
Bremerton, Washington, approving Phase I of Bay Vista (known
as Bay Vista South) Final Plat (File No. BP10-00008).
WHEREAS, On February 25, 2009 the City Council passed Ordinance No. 5077
granting approval of the Bay Vista Sub-Area Plan; and
WHEREAS, On July 9, 2009 the Administrative Hearings Examiner granted Bay
Vista Preliminary Plat approval after holding an open record public hearing to subdivide 82
acres, with associated open space tracts, and Rights-of-Ways; and
WHEREAS, Applicant is requesting Final Plat approval of a portion of the Bay
Vista preliminary plat known as the Bay Vista South Final Plat consisting of approximately 8
acres that includes 46 lots with 5 associated open space tracts and Rights-of-Ways; and
WHEREAS, all applicable conditions set forth in the Preliminary Plat approval
have been met; and
WHEREAS, the City Engineer and DCD Director recommend approval of the
Bay Vista South Final Plat, NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF BREMERTON, WASHINGTON,
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The Bay Vista South Final Plat as represented by the schematic
drawing in Exhibit A(Site Plan Layout) is hereby approved.
SECTION 2. The City Council President is hereby authorized to sign the Mylar.
SECTION 3. Severabilitv. If any one or more sections, subsections, or sentence
of this Resolution are held to be unconstitutional or invalid, such decision shall not affect the
validity of the remaining portion of this Resolution and the same shall remain in full force and
effect.
SECTION 4. E�'fective Date. This Resolution shall take effect and be in force
immediately upon its passage.
