The local sales and use tax is credited against the sales and use tax otherwise due to the State, resulting in no net change in tax to the taxpayer. The City has satisfied all prerequisites to imposing the tax and therefore prior to July 1, 2010, the City intends to incur general indebtedness and to issue bonds to finance the public improvements. The City will retire such indebtedness in whole or in part form the Local Revitalization Financing it receives. There were no comments from the public... 06:14:45 The Main Motion was made and seconded...Council Members then began their discussion... Mr. McConnell thought that the Administration was going to place this project on hold, and was confused that it was brought back to the Councit only three weeks later. He still believes the project should be put on hold and therefore would not support this action tonight. Mrs. Arends agreed, even though she thought it was a good project. City Council Reg. Mtg. Minutes Wednesday, April 21, 2010 Page3of5 Mr. Maupin agreed that this was a good project, but disagreed that the project should be put on hold because he actually thought this was a good time to proceed. Mr. Brockus agreed. Mr. Runvon asked if the project could be delayed. Ms. Stephenson stated that if the action is delayed, the Council can only act again at this same time next year when the financial climate will be unknown. Mr. Wheeler stated that using conservative numbers and last year's property tax as a baseline, he came to the conclusion that this was a good deal. 06:21:25 M/S/C (Wheeler/Runyon) Move to pass Ordinance No. 5108 imposing the local sales and use tax to be credited against the State sales tax for purposes of utilizing Local Revitalization Financing. The local sales and use tax is credited against the sales and use tax otherwise due to the State, resulting in no net change in tax to the taxpayer. The City adopted an ordinance imposing the Local Revitalization Fund Tax to be collected beginning July 1, 2010, and expects to receive not to exceed $330,000 annually. The City Council deemed it to be in the best interest of the City to borrow money by the issuance of limited tax general obligation bonds in a principal amount not to exceed $9,600,000, and to pledge to the repayment of the proceeds of the tax in order to provide funds to finance the Park Plaza Project; Lions Park renovations; and to purchase and renovate a building to be used as a municipal courthouse and to pay costs of issuing and selling the bonds. There were no comments from the public... 06:27:05 The Main Motion was made and seconded...Council Members then began their discussion... Mr. McConnell asked what the annual payment would be for the new amount of $9,600,000. Mr. Brockus stated that at the Finance Committee meeting earlier today, they learned that the amount would be $632,000 per year, and that is only if the City does not get the $2.2 million grant from the Federal Government. Mr. McDonald expressed his excitement over these projects, thought the timing was perfect to take advantage of the lower interest rate, and also had the added bonus of creating of new jobs. Mr. Maupin invited the Bond Counsel to provide further details. 06:42:40 M/S/C/U (Runyon/McDonald) Move to pass Ordinance No. 5109 providing for the issuance and sale of not to exceed $9,600,000 limited tax general obligation bonds of the City to provide funds with which to pay a portion of the costs of constructing a parking facility and Lions Park renovation; providing for the additional pledge of the sale of certain sales and use taxes; and providing for the terms of sale of the bonds; and purchase and renovation of building to be used as a municipal court house. There were no comments from the public... 06:44:25 The Main Motion was made and seconded... Council Members then began their discussion... Mrs. Arends was not in favor of deleting this department from the City code; and Mr. Runvon agreed. Mr. McConnell explained that the current position description is not accurate for the type of person the City woutd eventually need therefore he thought it would be better to go ahead and approve this action, and then bring the issue back later with an accurate description. Mr. Brockus agreed with this. Mr. Lubovich clarified however that if the position was brought back, it would not be a Department as it is now listed now in the code. Mr. Maupin stated that the Department should be eliminated from the Code now, and the Council could then update the language to match the newly created position when the time comes. 06:50:45 M/S/C (McConnell/Brockus) Move to approve Ordinance No. 5110 relating to the Department of Economic Development.
