WHEREAS, on the 8 day of September 2009, The City of Bremerton's Public Works
and Utilities Director submitted a petition to the Kitsap County Department of Public
Works requesting the vacation of the following described County right of way:
Described in Exhibit "A" and Depicted in Exhibit "B"
Attached liereto and by this Reference Made a Part Thereof.
WHEREAS, said petition was referred to the County Road Engineer for examination and
report to the Board of County Commissioners in writing; and
WHEREAS, on the 8 day of March 2010, the County Road Engineer filed with the Board
his report on the proposed vacation, giving his opinion that said right of way should be
vacated. Approval of the vacation is based on the following criteria:
The requested portion of land is a developed strip that was established as part of County
Road no. 154 on October 1, 1906. During the review process, various County departments
and reviewing agencies have determined that this portion of right of way is no longer useful
for public vehicular, pedestrian or parWgreen way purposes. Furthermore, this vacation
would benefit the public in that it will provide sanitary sewer mains for the Gorst along
with abandoning some 60 plus failing septic fields in the area. One of two lift stations for
pumping sewage will be built alongside this portion of vacated right of way.
In the opinion of the Department of Public Works, it is advisable that this portion of
developed right of way known as Change of County Road No.54 be approved for vacation
due to the following reasons:
1. WSDOT and KC Public Works traffic Division recommends this portion of
road be closed.
2. This portion of roadway does not provide any significant access or circulation
and has a history of frequent illegal dumping. �
3. A mutual Access and Utility Agreement has been signed by the abutting owners i
and the City of Bremerton. �

WHEREAS, by order of the Board of County Commissioners, the 22" day of March 2010,
at the hour of 7:00 p.c�n. was fixed as the date and hour of hearing of said decision to
vacate; the County Road Engineer's Report and notice of the time and place of said
hearing were given as provided by law; and
WHEREAS, said matter now coming before the Board for hearing this 22" day of March
2010, at the hour of 7:00 p.m., it appears to the Board from affidavits on file in the
proceedings that notice of hearing was duly given by publication and posting as required by
law. The Board having examined the Engineer's Report and having heard and considered
all testimony presented, there being no objection made to the proposed vacation, and
finding that the aforesaid County road is not useful as part of the County road system and
that the public will be benefited by the vacation, it is therefore;
ORDERED by the Board of County Commissioners, all members of the Board concurring,
that the Board's intention, to vacate said County right of way, Kitsap County, Washington,
as hereinbefore set forth and described, be and the same is hereby vacated.
BE IT FIJRTHER ORDERED, according to RCW 36.87.140 that the County reserve and
retain an easement within, over and across such road for ingress and egress and for the
construction, repair and maintenance of public utilities, which heretofore were authorized
and/or are physically located on any portion of such road.
