A RESOLUTION of the City Council of the City of
Bremerton, Washington, authorizing the City to execute ARRA
DWSRF Loan Amendment B for the UV Treatment Facility
Proj ect.
WHEREAS, the City has accepted an ARRA DWSRF "forgivable principal
loan" in the amount of $6,060,000; and
WHEREAS, this loan will provide $6,060,000 (including a loan fee of
$60,000 which is to be paid over a 5 year period at 0.00% interest) of the estimated
$7,240,000 required to complete this project. All costs incurred which exceed $6,000,000
shall be funded by the Water Utility Fund; and
WHEREAS, the current loan agreement requires that all activities identified in the
Scope of Work for the loan are under signed construction contract no later than February 17,
2010; and
WHEREAS, the City and the Department of Health desire to amend the Loan
Agreement to permit the activities indentified in the Scope of Work to be either under signed
construction contract or accepted as Force Account by the City no later than February 17, 2010;
and
WHEREAS, the Department of Health has mandated that in order to meet the
February 17, 2010 deadline, the City must adopt a resolution which allows the City to complete
the work by Force Account or under signed construction contract.;
WHEREAS, the City has advertised for bids from contractors to perform the work
necessary to complete the project and intends to have signed construction contracts for said work
by February 17, 2010; NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF BREMERTON, WASHINGTON,
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City of Bremerton desires to comply with a mandate by the
Department of Health to adopt a resolution which will allow the City to complete work by Force
Account or under signed construction contract.
SECTION 2. The City Council of the City of Bremerton does hereby authorize
the City of Bremerton to complete the UV Treatment Facility Project by Force Account or under
signed construction contract.
SECTION3. The Mayor is authorized to execute the ARRA DWSRF Loan
Amendment B which will allow the City of Bremerton to complete the UV Treatment Facility
Project by Force Account or under signed construction contract.

SECTION 4. Severabilitv. If any one or more sections, subsections, or
sentences of this Resolution are held to be unconstitutional or invalid, such decision shall not
affect the validity of the remaining portion of this Resolution and the same shall remain in full
force and effect.
SECTION 5. Effective Date. This Resolution shall ta.ke effect and be in force r
immediately upon its passage.
