Library, a Washington municipal corporation and a political
subdivision of the State of Washington thereinafter referred to
as "Library" ) and the City of Bremerton, a Washington municipal
. corporation and political subdivision of the State of Washington
(hereinafter referred to as "City").
W I T N E S S E T H:
WHEREAS, the residents of the City voted to annex into the
Kitsap County Rural Library District in September, 1985, the
annexation to be accamplished in January, 1987; and .
WHEREAS, the Library and City reached agreement as to the
terms and conditions of the annexation which were memorialized in
a Concomitant Agreement executed the 13th day of August, 1985, by

WHEREAS, said Concomitant Agreement is in need ot revision
to reflect changes in circumstances since the original agr2ement
was entered into; and
WHEREAS, the citizens of the City of Bremerton in November,
1974, passed and approved a general obligation bond which was
promulgated by Ordinance No. 3163 ana is referred to as the 1976
_
General Obligation Bond of the City of Bremerton; and
1
 i
 • ,
WHEREAS, the levy within the City limits for the 1976 •
General Obligation Bond from time to time may fail to cover the
City's annual payment on the General Obli`gation Bond; and
WHEREAS, the Library desires to maintain clear title to all
the assets of the KitsapRural Library District, now, therefore
FOR AND IN CONSIDERA'rION of the mutual covenants and
promises contained herein, and the mutual benefits to be derived
therefrom, the parties hereto agree to amend the Concomitant
Agreement executed on the 13th day of August, 1985.
1. New sections are added to the Concomitant Agreement to
read:
(a) Payments: Library agrees to pay to the City the
annual deferential (if any> between ; the amount of levy raised '
within the City for the 1976 General Obligation Bond, and the
actual annual payment required on said General Obligation Bond.
(b) Attorney Fees: In the event of litigation between
the parties concerning this contract, the prevailing party shall
be entitled to reasonable attorney fees and costs of litigation.
2. Section 3 of the Concomitant Agreement is revised to
read:
Conveyance of I'itle: In consideration for Library's
payment of the annual deierential as defined above, the City
• agrees that Library shall retain title and ownership of City's

5ylvan Way in the City of Bremerton, plus the City's interest in
all Library equipment, supplies, books, and any and all ottier
personal property purchased by the City for Library purposes.
2 . .
, , •'
Because these amounts have depreciated in value over time,
conveyance by the City in consideration for the Library's payment
upon the 1976 General Obligation,Bond is just and equitable.
3. This Agreement is intended as an addendum to and a
revision of the Concomitant Agreement of the 13th day of Aug ust,
1985, and is designed to reflect the actual conditions and
working relationship between the parties. All provisions of said
Agreement not amended by this instr ument shall remain in full
force and effect.
IN WITNESS WHEREOF the parties have executed this Agreement
as of the day and year set forth above. `

the State of Washington (hereinafter referred to as the "City").
WITNESSETH
WHEREAS, the Library extends library services to the
City pursuant to the provisions of the library laws of the State
of Washington, and the City compensates the Library therefor
pursuant to a contract entered into between the Kitsap County

1955, contract for future years;
NOW, THEREFORE, for and in consideration of the mutual
covenants and promises contained herein, and the mutual benefits
to be derived therefrom, the parties hereto agree as follows:
- FUNDING

THOUSAND DOLLARS ($250,000.00). The then remaining balance of
said contracted amount, TWENTY-THREE THOUSAND FIVE HUNDRED TWO

applied to the City tax base as was applied to the
tax base of the Rural Library District.
3. It is further agreed that this funding formula is
conditional upon the right of either party to set aside this
manner of funding and to renegotiate, in good faith, subsequent
funding terms in the event of a substantial change of

substantially change funding of rural library
districts•or municipalities;
B. Should the county assessor change the
property reassessment schedule in the Rural Library
District;
C. Should the City increase its tax base by
substantial incorporation of areas around it.
The renegotiation of the funding formula shall be accomplished
within ninety days following any of the above enumerated changes.
During this period of renegotiation the funding formula shall
continue to be as is set forth above. Once a new formula has
been renegotiated, it shall be effective retroactively from the
date of one of the above enumerated changes.
4. The f unding formula set forth in paragraph 2 above
shall be reviewed every fourth year by both parties for
adjustments, which adjustments will be ratified by both parties.

the same manner as has been the practice and custom with respect
to said building as between the City and the Library since the
initial use by the Library of said building, and as performed
under the 1955 contract. The Library shall continue to meet its
responsibilities and performances as has been the custom and
