An inspection today revealed furniture and garbage on the sidewalk and further revealed a large quantity of mattresses, garbage and other debris in the yard of your property. This condition is defined as a nuisance in Chapter 6.02 of the Bremerton Municipal Code and is a violation of Chapter 6.04 of the Bremerton Municipal Code, which prohibits the disposal of debris and garbage in this manner. Trash is getting bigger 03/25/2016 City of Bremerton, As one of the Clare Avenue residents (specifically me, 2866 Clare Ave), my concern is this: the president with mail box 2980 (alleyway), keeps putting trash out that Waste Management does not collect. Why is it still there? Where is it supposed to go and why does it have to remain? This is becoming an eyesore and does riot seem to be going away anytime soon. As a home owner, I am not pleased with the prospect of being classified as living in a ghetto. This is really of great concern to me. Erecting, maintaining, using, placing, depositing, leaving or permitting to be or remain in or upon any premises, which may be viewed or smelled from without the premises, or in or upon any street, alley, sidewalk, park, parkway, or other public or private place in the city, any of the following disorderly, disturbing, unsanitary, fly - producing, rat -harboring, disease -causing places, conditions; or things: 3. An accumulation of material including, but not limited to, bottles, cans, glass, plastic, ashes, scrap metal, wire bric-a-brac, broken stone, broken crockery, broken glass, broken plaster, litter, rags, empty barrels, boxes, crates, packing cases, mattresses, bedding, packing hay, straw or other packing material or building materials including lumber, plumbing materials, wallboard, sheet metal, plaster, brick, cement, asphalt, concrete block, roofing material, cans of paint and similar materials which are not properly stored or neatly piled or is offensive to a reasonable person or in which flies or rats may breed or multiply. 4. Accumulation of any garbage and refuse as defined in chapter 6.04 BMC. 6.04 GARBAGE AND REFUSE 6.04.030 (c) "Rubbish" shall include all non-putrescible wastes, including, but not limited to: (1) Broken or discarded furniture, household equipment, appliances and furnishings, and personal belongings; (2) Salvage materials and automobile parts, including but not limited to, tires, wheels, engine parts, body parts, interior parts and auto glass; and (3) Abandoned, broken or neglected equipment and machinery. 6.04.040 ACCUMULATION AND DISPOSAL OF REFUSE (a) It shall be the duty of every person who owns or is in possession, charge, or in control of any dwelling, flat, roominghouse, group home, apartment house or other multi -residential unit, hospital, school, hotel, club, restaurant, boardinghouse, or eating place, or who owns or is in possession, charge or control of any shop, place of business or manufacturing establishment: where garbage, refuse or swill is created or accumulated, at all times to keep or cause to be kept portable appurtenances, metal or other approved containers in sufficient numbers, for the deposit therein of garbage, refuse, and recyclables, and to deposit or cause to be deposited the same therein. Upon request, the garbage collector may provide a solid waste container larger than the standard garbage container that may be suitable for automated pick up. (b) The lids on garbage containers shall not be removed, except when necessary to place garbage and refuse in such cans or take the same therefrom. When garbage and refuse is placed therein or taken therefrom, such lid shall be securely replaced by the person placing the same therein or taking the same therefrom. Such containers shall be kept in a sanitary condition with the outside thereof clean and free from accumulative grease and decomposing material. Each container shall be kept in a place easily accessible to the garbage truck on collection day and shall be removed from the city right-of-way between collection days. The property owner and occupant is responsible for ensuring that the lids are properly secured on the containers and that said containers are removed from the right-of-way between collection days. 2 1 6.04.050 UNLAWFUL DISPOSAL (a) It shall be unlawful for any person to bury, burn, dump, collect, deposit, or in any manner to cause, permit, or allow the disposal of refuse upon any street, alley, public place or private property within the City, otherwise than as provided in this Chapter. CORRECTIVE ACTION: Remove and properly dispose of mattresses, furniture, appliances, garbage and debris. SUBMIT RECEIPTS FROM A PERMITTED DISPOSAL FACILITY OR SOLID WASTE TRANSPORTER TO THE CITY OF BREMERTON AS PROOF OF YOUR COMPLIANCE WITH THIS ORDER. WITHOUT RECEIPTS, THIS MATTER CANNOT BE CLOSED. As the person responsible for this violation, you must complete the above described corrective action by April 20, 2016, or a Notice of Civil Violation may be issued and you will be scheduled to appear before the City Hearing Examiner. When garbage and refuse is placed therein or taken therefrom, such lid shall be securely replaced by the person placing the same therein or taking the same therefrom. Switzer #451 INFORMATION: On 10/07/2015 at approximately 1632 hours, while working as a uniformed made contact via telephone with Cheryl DEBUSSCHERE for the report of J CONTACT DEBUSSCHERE: REPORT Dispatched: 16:32 Arrived: 16:32 Cleared: 17:22 Case Number: B15-007960 officer for the City of Bremerton, I DEBUSSCHERE said she lives at 2866 Clare Ave and for the last couple weeks has seen a pile of trash outside of 2888 Clare Ave continue to grow to the size it is currently, which is now protruding into the road. DEBUSSCHERE said she and other residents in the neighborhood now have to swerve around the trash due to how far it is in the roadway. DEBUSSCHERE said she has contacted waste management about it, but was told they would not pick it up. I conducted a patrol check of the area and could see the trash pile DEI protruding into the roadway and on the sidewalk. See attached photos. Due to recent calls for service in that area, I was familiar with Obie COLE sidewalk in that area. CONTACT COLE: I made contact with COLE via telephone and advised him of the situation. I n recent history and recalled he had some of his belongings placed in that same COLE said he did once have belongings that were in the pile I was speaking of, belong to Virginia JORDAN (the owner of his residence) and Jordan ZYVIX. C road is not his and believes it to be trash.
