SUBJECT: An Ordinance amending BMC Committee Meeting Date: October 28, 2009
6.32, Noise Levels. COUNCIL MEETING Date: November 4, 2009

SUMMARY: Adopt an Ordinance to reflect the following:
1) Revise BMC Section 6.32.070, "Variance Procedures" to replace the review authority from the
"Planning Commission" to the "Administrative Hearing Examiner". In Apri12002 the City
changed its quasi judicial body to the Hearing Examiner. In October 2009 it was brought to
the City's attention that the procedures for the Noise regulations were inadvertently missed
and thus not consistent with the 2002 change; and
2) Revise BMC 6.32.090, "Right to Appeal" to replace the appeal authority from the "Hearing
Examiner" to the "Superior Court". As the Hearing Examiner will be the initial review
authority for the "Variance Procedures" a different authority is required for an appeal.
