GENERAL BUSINESS
7 A - RESOLUTION NO. 3091 ADOPTING THE BREMERTON COMMUNITY SCHOOL OF THE
FUTURE, CO-LOCATION PROJECT STUDY: Andrea Spencer, Director of Community Development,
explained that in 2006, the Washington State Office of Public Instruction (OSPI) and the Department of
Community Trade and Economic Development (CTED) held the Summit on School Siting. The premise
of the summit was that school districts and local jurisdictions can work in concert to mesh education
facility needs with broader community needs and the growth strategies of cities. The City of Bremerton
(City) and the Bremerton School District (District) were awarded a grant by CTED to work cooperatively
to study the concept of locating a new middle school on the west side of Bremerton and that this study
was to use the findings of the Summit of School Siting as a guide. Ms. Spencer was very pleased that
the City and the District worked together to complete the work on this study and staff is bringing it
forward to the respective governing bodies for adoption. Kevin FlanniQan with NAC ARCHITECTURE was
brought forward to provide a PowerPoint@ presentation with further details on the project.
Richard Nerf was proud of the study and how people have demonstrated that they are changing their
attitude about the community's needs.
06:10:45 Main Motion was made and seconded; then discussion by the Council was opened...Following
discussion, the final vote was taken.
City Council Reg. Mtg. Minutes

Roy Runyon offered comments in support; and thanked Mr. Nerf and other members of the community
for participating in the process.
Will Maupin hoped that the eventual location of the school will benefit everyone.
Brad Gehrinq expressed concerns from constituents regarding the potential cost of creating a new site
and that existing buildings are not being considered in the study.
Mike Shepherd hoped that the location of the school would reduce the amount of transportation needed
by children if schools are located near where children live and play.
Nick Wofford emphasized the importance of safety around schools, which includes sidewalks.
06:18:52 M/S/C (Runyon/Brockus) Move to pass Resolution No. 3091 adopting the Bremerton
Community School of the Future, Co-Location Project Study.
Voted in favor of Motion: Runyon, Shepherd, Robinson, Maupin, Wofford, Brockus, McConnell
Abstained: Gehring
Motion carried: 7-Yes; 1-Abstention
7B - FIRST AMENDMENT TO AGREEMENT WITH REDFLUX TRAFFIC SYSTEMS, INC FOR PHOTO
ENFORCEMENT SERVICES: Andy Parks, Financial Services Director, stated that the City and Redflux
entered into an agreement dated September 10,2007. Original agreement includes a 5-year term with
options to extend. Additionally, the cost per intersection monitored is $4,850 per month. City discussed
alternatives to reduce monthly costs. Redflux's proposal is to extend the original term to 10 years and
reduce monthly monitoring cost of existing intersections (a total of 9) form $4,850 per month to $4,000
per month per intersection (total of $7,650 per month savings) which represents an annual savings of
$91,800. The other terms of the agreement remain in effect including the "neutrality" clause, which limits
the City's cost to the revenue generated from the system.
There were no comments from the public. . .
06:21 :45 Main Motion was made and seconded; then discussion by the Council was opened.. .Following
discussion, the final vote was taken.
Mr. Shepherd does not believe that the traffic cameras are there for safety reasons and therefore did
not support this proposal.
Mr. Brockus also continued to object to the use of the cameras and encouraged people to follow the
law by coming to a complete stop at red lights.
Ms. Robinson asked for statistics on how the camera program is supporting itself financially. Mr. Parks
answered that the revenue provided is approximately $70,000 monthly while monthly costs for the
contract is $44,000, and $7,500 shared between the Police Department, Municipal Court, and
Prosecutors.
Mr. Shepherd asked if the $70,000 is ticketed revenue; and if the court administration setting hearings
is included in the $7,500 cost figure. Mr. Parks answered yes to both questions.
Mr. Gehrinq supported the use of the traffic camera system; hoped that people will follow the law and
be more careful at intersections; and believed that the police review of infractions has been fair and
timely.
Mr. Runyon asked if state law changed, then what obligations would there be with Redflux to the City?
Mr. 'Lubovich responded that the contract with Redflux would become null and void.
City Council Reg. Mtg. Minutes
Wednesday, June 17,2009
Mr. Maupin commented that he has seen improvement in safety with the use of the cameras; and
believed if the cameras were phased out drivers would go back to their bad habits and then police
officers would be spending more time clearing collisions.
06:37:55 M/S/C (Gehring/Runyon) Move to approve the proposed amendment to September 2007
agreement between the City and Redflux Traffic Systems, Inc. and authorize the Mayor to finalize and
execute the amendment with substantially the same terms and conditions as presented.
Voted in favor of Motion: Robinson, Maupin, Wofford, Gehring, Runyon, McConnell
Voted opposed to Motion: Shepherd, Brockus
Motion carried: 6-Yes; 2-No

the public to drive extra carefully now that schools are out for the summer.

but was disappointed that one of his campaign signs was taken from his own yard. He also reported
that the Manette Neighborhood Coalition has planted some new plants on East 11th Street between
Trenton Avenue and Shore Drive and that this project was supported by Community Development Block
Grant (CDBG) funds.

COUNCIL SUMMARY
Union Avenue and Hilltop Lane
Summary
This project combines two smaller water main projects which have been
identified in the City's Capital Improvement Project (CIP) list for two different
reasons.
Union Avenue is a 12 inch main being run on Union Avenue from approximately
the south edge of the State Patrol property up the hill 1400 feet to connect to the
existing system at Linden Street, or the National Guard Armory/Emergency
Services complex. This project is being completed to allow fire flow to be
provided at the complex.
Hilltop Lane is approximately 2000 feet of 8 inch main being run the entire length
of Hilltop Lane from Chico Way, then looping back to Chico Way to provide a
future connection for a proposed development on Country Lane Road and up the
west side shoulder for one residence. This project is being completed for two
reasons:
. Inadequate main size for fire flow.
. Abandon the existing main which has had a private drainfield constructed
over the top of it.
Fiscal Summary
Funding for the project is by the City's Substandard Main Fund. Engineer's
estimate for construction is ~~3;5b If\ 8:

COUNCIL SUMMARY
RESOLUTION APPROVING SOLE SOURCE PURCHASE OF INDIVIDUAL
GRINDER PUMP STATIONS FOR THE GORST SEWERAGE PROJECT
Resolution Summary
The Gorst Sewerage project will require individual grinder pump stations for the
low lying homes - between 25 and 40 pump stations are anticipated at this time.
The new Engineering Design and Construction Standards require grinder pumps
to be E-one pumps. E-one pump stations were selected since they are an
excellent product with a proven track record, their standard product can perform
in all known City pump conditions, and also since Correct Equipment (E-one
manufacturer's representative) is the only known entity that will assume
responsibility for operation, maintenance, and first response for grinder pumps.
Written direction from the Department of Ecology has indicated that
municipalities are responsible for the ownership and maintenance of individual
grinder pumps per WAC 173-240-105. In discussions with Correct Equipment,
they have indicated that they will perform an annual inspection of each individual
pump, and will also be first response for calls at a cost of approximately
$50/pump-year. Discussions were conducted with other pump manufacturers
and their representatives, who indicated that they did not provide that service.
Fiscal Summary
The City has not yet received grant or loan agreements from the Department of
Ecology for the Gorst Sewerage project; however, in discussions with their staff,
we understand that sole source purchase of equipment requires a resolution to
be adopted to allow the items purchased to be compensated by the ARRA
funding. The purchase value of each grinder pump is approximately 4,000.

COUNCIL SUMMARY
EASEMENT PURCHASE FOR PUMP STATION SB-4 AND COLLECTION
SEWERS FOR THE GORST SEWERAGE PROJECT
Contract Summary
The Gorst Sewerage project will construct two separate collection systems that
pump into the SW Bremerton Forcemain; one system will be located north of
Gorst Creek, and the other South of Gorst Creek. The southern system will be
configured to flow to the low point which is at the property owned by Raymond
Gardner, Greg Hunt, and Joan Hunt. The property currently houses the "Hunt
Homes" business which sells manufactured homes. Extensive negotiations with
both the owners of the Hunt Homes property and the adjacent property to the
north have concluded that the best location to site the new pump station is on the
northeast corner of the Hunt Homes property. Collection sewers will convey flow
across the SR16 frontage of the Hunt Homes property to the new pump station.
While these collection sewers will be located within WSDOT right-ot-way, a small
easement will be required on the Hunt Homes property for maintenance of the
new sewer mains.
The owners ot the Hunt Homes property have agreed to sell permanent
easements tor Pump Station SB-4, and the collection sewer. The attached
market analysis indicates that easements for the pump stations should be
compensated at 100% of the property value, while easements for utility lines
should be compensated at 50% of the property value. City staff and the property
owners have agreed on a value of $12.41/sf for the Hunt Homes property. The
Pump Station easement is 1,854-sf, and the small triangular easement is 365-sf
in area. The property owners have further requested that their existing buildings
be connected to the new sewer at no cost.
Fiscal Summary
Property purchases are not eligible for funding by the grants or loans offered for
the project. The 2009 Wastewater Fund budget was increased to $7,105,000 on
May 20, 2009 to fund the Gorst Sewerage Project. This easement is included in
the projected 2009 expense for the project.

Market Value Opinion
Land Value in Gorst - TexacolHunt
The purpose of this report is to provide my opinion of current market value for properties
fronting onto State Highway #16 located at the head of the bay in Gorst. Specifically, the
objective is to detennine the value or fair compensation for utility easements to be secured
upon these properties. The subject land includes three separate tax parcels. This exercise is
strictly intended to address value of land, as opposed to any improvement which is located
upon the various properties. These properties are very high traffic locations which have
exceptionally good visibility and retail exposure. The properties are contiguous and located on
the west side of the big bend of State Highway #16 in Gorst. These properties are essentially
located at the interchange of State Highway #16 and State Highway #3. A mini storage
property is located along the westerly boundary for all three properties. These properties are
all zoned Highway Tourist Commercial (HTC) within unincorporated Kitsap County.
Topography is level and at-grade with adjacent streets. Highway #16 has a center island and u-
turn lane which allows access to these properties from either direction of State Highway #16
traffic flow.
The three properties are summarized as follows:
1. 4121 State Highway #16 in Gorst. Kitsap County tax account parcel number 4539-000-
002-0000. The north side of the property is defined by State Highway #3. Total site size is .94
of an acre or 40,946 square feet per Assessor records. Site is a slightly irregular square (except
for frontage along Highway #3 to the north). The site is fully improved with paving or
building. There is a single story concrete block building having 17.385 square feet originally
constructed in 1946 per Assessor records. The building is multi-use and multi-tenant. The
primary tenant is a 76 gas station and convenience store. A canopy and 5 pump stations are
situated near the NE corner of the site. The site contains underground fuel tanks.
2. 4101 State Highway #16 in Gorst. Kitsap County tax account parcel number 4539-000-
004-0107. Site area is .13 of an acre or 5,663 square feet per Assessor records. The site has
56.80 feet of frontage onto State Highway #16. Shape of the lot is somewhat triangular with
the frontage being much wider than the back of the property. Single story wooden building
having 768 square feet. Originally constructed in 1977 per Assessor records. Site is fully
improved with pavement and building. Currently vacant.
3. 3450 State Highway #16 in Gorst. Kitsap County tax account parcel number 4539-000-
005-0106. South side of property is defined by a spur of State Highway #16. Site area is 1.79
acres or 77,972 square feet per Assessor records. Shape of lot is roughly a square. Site is fully
paved. No permanent structures appear to exist on-site. The lot is used as a sales lot for
modular/mobile homes.

Esablished J 979
2007 traffic counts from Washington State Departme~t of Transportation suggest annual daily
traffic past the subject property along Highway #16 is approximately 67,000 vehicles per day.
In addition, traffic along the spur of Highway #16 to the south of the subject property was
approximately 9,300 vehicles per day.
The nature of a gasoline sales operation with underground tanks provides opportunity for soil
contamination to surrounding property. This report was done without benefit of an
Environmental Site Assessment. Conclusions are based upon the assumption there is no
significant soil contamination to any of the subject properties for this report.

The commercial real estate market has been negatively impacted by the faltering economy.
Kitsap County has not been immune to this downturn. As a result, commercial real estate
values are estimated to be down 15% to 20% over the past year or more. Comparable land
sales during this time are limited. Sales for properties which are similar in nature and located
near the subject property are scarce.
A few sales in the greater Gorst area include:
1. 4201 Highway #3 - intersection of Highway 3 and Frone Drive. Occupied by Real Estate
2000 Corporation. 13,500 square feet site. Zoned HTC. 4,360 square foot retail building
constructed in 1976. Sold in April 2008 at $480,000.
2. 3900 Sam Christopherson Avenue - near intersection with Highway #3. 29,200 square foot
site. Zoned me. 1,838 square foot residential building constructed in 1960. Sold March
2006 at $250,000.
3. 3282 State Highway 16 - next to Mattress Ranch. 37,897 square foot site. Non Highway
frontage. Fronts onto Sinclair Inlet. Zoned lITe. Two older commercial buildings of 800
square feet and 430 square feet. Sold in September 2006 at $200,000.
Land Value Conclusions
All 3 of the subject sites for this report have exceptionally high traffic exposure and excellent
visibility together with level and at-grade topography. Zoning and allowable uses are identical.
The comer lot including the 76 Gas Mart site is a slightly superior location due to ease of
access to higher levels of traffic, specifically that flowing along Highway #3 coming/going.
between Belfair and Bremerton. The value of the raw land of the 76 Gas Mart site (lot #002) is
believed to be $12 per square foot.
The other two parcels (lots #004 and #005) do not have this added exposure benefit. The raw
land value for lots #004 and #005 are believed to be calculated at $10 per square foot of land
area.
Easement Considerations
The proposed easements can be viewed as two different types of impacts on the commercial
properties. The frrst type of easement is an underground utility line which will cause a
temporary disruption of use to the easement area during construction/installation, but will be
returned to its prior condition and use immediately thereafter. It is my opinion that fair
compensation for this type of easement is 50% of the fair market land value for that land area
defmed within the easement.
The second type of easement includes improvements which eliminate the ability for the
property owner to otherwise use the surface of the property. This means the property owner
could not use the area for parking or driveway or building after improvements within the
easement area were completed. It is my opinion that fair compensation for this type of
easement is 100% of the fair market land value for that land area defined within the easement.
An easement of this nature could also negatively impact surrounding or adjacent land and
thereby have a financial impact which is greater than the value of the land upon which the
easement is secured. I do not believe this is the case based upon the schematic I reviewed.
Conclusions
1. Fair market value for the proposed easement area to install underground utility lines in the
SE corner of lot #5 is believed to 50% of $10 per square foot, or $5 per square foot of
easement area.
2. Fair market value for the proposed easement area to install underground utility lines along
the northerly portion of lot #5 is believed to 50% of $10 per square foot, or $5 per square foot
of easement area.
3. Fair market value for the proposed easement area to install a pump station at the border
between northerly portion of lot #5 and southerly portion of lot #2 is believed to be $10 per
square foot. Given the hidden nature of this location on the back side of lot #002, it is
wrreasonable to apply a rate greater than $10 per square foot to this affected easement area.

Subject: Sanitary main and lateral Pacific Ave. Upgrades
After reviewing the current condition of the sanitary main and active laterals within the footprint of the
upcoming Pacific Ave. Improvement Project we have determined that utilizing CIPP technology on both
the main and laterals is the logical and least disruptive option.
Issues of concern are difficulty in excavation due to the depth, location, proximity to existing utilities
and maintaining safe and effective traffic flow through the downtown area.
Rehabilitation using the cured in place system on the mainline and laterals in conjunction with "Inner
Seal" system at the connection points will assure the collection system to be free from structural defects
for years to come, eliminate the possibility of future damage to the upcoming above ground
improvements and address the crucial aforementioned concerns.
I am attaching a quote from Pipe Experts LLC to perform this work for your review and consideration;
we have worked with this outfit on several occasions and have found them to be professional, efficient
and very cost competitive.
I have also reviewed the current Small Works Roster and found no other businesses capable of
performing the work with these technologies, therefore identifying them as a "sole source" provider.
If I can provide any additional info please let me know

RE: Pacific Ave Sanitary Sewer Rehabilitation Project
Pat:
Thank you for considering the Experts and we welcome the opportunity to work together. We have
provided Project Purpose, Project Scope, Price Estimate for your review.
Project Purpose:
The purpose of this project is to repair the downtown Pacific Ave Sewer lines using trench less Cured in
Place technology before the above ground streets are reshaped with planters and paving.
Insure that No future digs in the street after Reconstruction of the Downtown Streets, sidewalks and
planters.
Time is of the essence as the Street portion of this work must be completed by this summer.
We considered the following options:
1. Open Cut - To disruptive to downtown traffic flow.
2. Pipe Bursting - Digging for insertion and pull pits was too disruptive.
3. Cured in place Pipe - CIPP of the main lines was the most cost effective and less disruptive.
CIPP of the lateral should also be done at the same time to insure no future digging in the Downtown
area.

Dear Gary:
, The purpose of this correspondence is to advise you that Emmanuel Apostolic Church
has performed all the necessary due diligence with respect to the acquisition of the 8th
and Park property.
Accordingly, we would appreciate moving forward with the purchase agreement. I
would also want to know whether there are any other details we need to address so
that we can move forward expeditiously.
Thank you for your attention to this matter.

Honorable Members of the Bremerton City Council
June 26, 2009
Dear Ladies and Gentlemen:
I want to take this opportunity to express my appreciation for you allowing
our purchase proposal to be added to the agenda for next Wednesday's
council meeting. Your action affords Emmanuel Apostolic Church, (EAC),
to finally start work in earnest on our vision to provide opportunity for all
the citizens of Bremerton.
There are a couple of things I would like to bring to your attention for the
sake of clarity. First I did hear your discussion regarding the issue of
appropriate public notice of the intended property sale. I want you to know
that we do not oppose such a move if you so choose. Secondly, I want to
speak to the matter of resources that may come from a Brownsfield grant. I
would anticipate such funds to be EAC receipts. While I recognize the need
for the city to recoup its costs to acquire and "clean up the site", I understand
the total costs were in the $400, 000.00 range.
More specifically, if we are allowed to purchase the property, I would expect
that a Brownsfield award would accrue to EAC recognizing that EAC will in
fact be the entity which is utilizing the property for the benefit of the city. It
is my further understanding that an application for the Brownsfield grant has
been prepared and submitted but the resources have not been awarded. If this
is the case, and again, if we are allowed to purchase the property, we plan to
aggressively pursue the grant award.

Dear Mr. McConnell:
I am writing to inform you that I hereby formally rescind our letter of June
26,2009, where I referred to resources that may be forthcoming from the
Brownsfield grant. In particular, I have decided that we will not make
application for any funding from the grant.
In good faith, I recognize that the City of Bremerton has paid $325,000.00
for acquisition of the site and that the City of Bremerton has paid an
additional 95,000.00 for toxic cleanup. Accordingly, I withdraw my letter of
the 26th herewith.
I would, however, appreciate it if you would add me to your agenda where
public comments are heard. Please contact me should you have any further
questions. I will be happy to respond.

Lions Park Master Plan
June 29, 2009
Council President Cecil McConnell
Parks Committee Chair Will Maupin
Re: Lions Park Master Plan
Recommendation from the Parks & Recreation Commission
Gentlemen:
I am pleased to be writing to you about the proposed plan for Lions Park. I would love to be able
to give personal testimony at your July 1 st public hearing, but my job will prohibit me from being
there. Instead, I hope you will accept this letter as part of that public input.
The Parks & Recreation Commission voted unanimously to recommend this plan to you. I think
there are three things that led to this support:
1. The process was open and inclusive. The Lions Park project is the latest example of
excellent community engagement from Bremerton's Parks and Recreation
Department. Staff members have been reaching out to a variety of communities -
neighbors, the elementary school, and gardeners at Blueberry Park, neighbors and
church communities at Stephenson Canyon, and now neighbors and recreational users
at Lions Park. They demonstrate responsiveness and the ability to listen to
community members, incorporating suggestions that work and explaining why others
won't. To a person, neighbors and other community members at the last commission
meeting were thankful and complimentary of the process and the plan that resulted.
City leadership should be proud of how this department can take divergent views and
bring people together to a common end.
2. It addresses one of Bremerton's most sh!llificant environmental issues:
stormwater run-off. This project was a great fit with the grant opportunity and will
also remove the unsightly asphalt currently on the waterfront. The existing wetland
will also be enhanced during this redevelopment.
3. It is a verv excitin2 plan. It changes a significant part of the park to a more passive,
open space for use by a much broader population. I believe this work can be one of
the cornerstones of enhancing that residential neighborhood and the broader region.
The commission did discuss the loss of the poplar trees and felt that their overall
condition warranted removal.
On a personal note, I would also like to commend the City for continuing to work
collaboratively with the school district on joint use of facilities. In the Lions Park instance,
the loss of practice fields has prompted discussions regarding the upgrade of selected school
district baseball diamonds to expand the opportunity for use by Bremerton residents. I have
long been a supporter of a joint school/community center in West Bremerton and am pleased
with the current work being done by the citizen group. I must also confess that I would love
to see an east side community/senior center, perhaps at the old East High/Bremerton Junior
High site, utilizing existing recreation facilities. That dream is a ways off, but I firmly believe
that we can demonstrate significant savings to Bremerton taxpayers with this kind of
planning and collaboration.
Thank you for your consideration of this input as you review the Lions Park plan. The
commission feels that this is an important project for this neighborhood, and we look forward
to further planning work on Lions Park and the surrounding area.
Sincerely,
: I( '. 'I

George,
I wish to confirm that with respect to Policy CF-57 it is the intent of Port Orchard to coordinate and collaborate with the Port of
Bremerton and the City of Bremerton in regards to potential future wastewater infrastructure improvements within SKIA. That is
what I understood the parties previously agreed to and that is the intent of Port Orchard even if the text does not say that as
clearly as it could have because of an editing error I made.

Wastewater System Summary
Ordinance No. 014-09
The City of Port Orchard Public Works Department provides wastewater service in
coordination with the West Sound Utility District to the citizens of Port Orchard, as
well as the majority of the citizens in adjacent Urban Growth Areas. The wastewater
service areas include the Port Orchard Urban Growth Area, the McCormick Woods
Urban Growth Area, and a p.otentii1l(lltlJr~ s.erVIc;~.area including the South Kitsap
Industrial Area Urban Growth Area. The City of Port Orchard has developed
Comprehensive Sewer Plans in coordination with both Kitsap County. West Sound
Utility District (Formerly Karcher Creek Sewer District), most recently updated in
December 2006 (Ordinance 026-06) Ongoing Wastewater Capital Facilities Plans. It is
based upon information available to the City and from several consultant studies as well
as joint West Sound Utilities District data, analysis, and input. The existing Wastewater
Plans provide an in-depth analysis of the system characteristics and potential areas for
improvement and expansion using a twenty-year time frame. This Wastewater Plan will
be updated in the very near future as changing demographics and technologies arise in
coordination with shifting needs resulting from annexation, and most likely the
Wastewater Capital Facilities Plans will be updated yearly. To help protect water quality.
it should be noted that the City's Shoreline Master Program already requires the
installation of sewage disposal facilities at private and public marinas.
The population served by the system was estimated in Equivalent Residential Units
(ERU) which account for people present on a daily basis but who may not be residents
(e.g. school children or employees). Metered water use is based upon 180 gallons per
day, which is a State standard. The projected system population is based upon current
trends in water system use. Unanticipated major new developments are not included in
this calculation.
The basins within the Wastewater Service Area conform to the service area of the
system including the South, Central and East branches. The Southern branch serves
from Pottery Avenue northward along Port Orchard Boulevard. The Central branch
serves from the intersection of Sidney Avenue and Tremont Street northward along
Cline Avenue. The East branch serves the area to the east of Blackjack Creek. The~e

Port Orchard Marina and are pumped to the treatment facility in Annapolis.
Improvements recommended in the Sewer Plan are for increased maintenance and
replacement of basin areas that have high inflow and infiltration. Inflow and infiltration
result from rain water leaking into the lines during storms, filling up the lines and
requiring the distribution system and treatment plant to handle more water than is
necessary. In older areas of the City this problem is largely due to side sewer
connections. In order to make any meaningful improvements to the system, expensive
basin-wide repairs would be necessary. This would include replacing both laterals and
side sewers. The City's studies recommend an alternative approach (bio-membrane
package scalping plants) to assist in the major replacement of increased maintenance and
Ordinance No. 014-09

repair to extend and increase the efficiency of the existing laterals and trunk lines. It has
been determined that there is little growth potential in the Eastern branch service basin
because it is bordered to the east by the West Sound Utility District. The Central
branch is surrounded by the service area of the Eastern and Southern branches. The
Southern branch appears to be in the best position to serve most of the undeveloped
properties in, and surrounding, the City.
