ORDINANCE NO. 50 gS
AN ORDINANCE of the City Council of the City of
Bremerton, Washington, revising and correcting the City
boundaries of streets, roads or highway rights-of-way located
within the City by approving a new legal description of the
boundary of the City of Bremerton.
WHEREAS, The City of Charleston began annexing areas of Kitsap County in
June of 1904, and the City of Bremerton in September of 1918, with the two cities consolidating
in December of 1927 and annexations continuing to be done to this day;
WHEREAS, previous annexation descriptions, while intending to be contiguous
to existing City boundaries, have created numerous hiatuses or pockets of county right-of-way
and properties within the City limits;
WHEREAS, previous annexation descriptions have divided roadways and shared
maintenance responsibilities between the City and the County and the City desires to correct
these discrepancies and better define these responsibilities;
WHEREAS, the City has identified certain streets, roads and rights-of-way that
are partially within the City limits and desires to correct these discrepancies as well as others not
specifically identified; and
WHEREAS, the City, in accordance with RCW 35.21.790, makes these
corrections to streets, roads and rights-of-way boundaries and all areas traditionally thought to be
inclusive to the City and further has created a new legal description which encompasses the
entire City limits; NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF BREMERTON, WASHINGTON,
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Corrections are hereby made to streets, roads and rights-of-way
boundaries to include such areas within and as part of the City in accordance with RCW
35.21.790 as set forth in Exhibit A.
SECTION 2. The legal description as set forth in Exhibit B is hereby accepted
and approved as the boundary of the City and that all areas, public or private within said legal
description shall be included within and be part of the City of Bremerton.
SECTION 3. Severability. If anyone or more sections, subsections, or sentences
of this Ordinance are held to be unconstitutional or invalid, such decision shall not affect the

validity of the remaining portion of this Ordinance and the same shall remain in full force and
effect.
SECTION 4. Effective Date. This Ordinance shall take effect and be in force ten
(10) days from and after its passage, approval, and publication as provided by law.

EXHIBIT A
The following is a list of roadway right of ways and portions of properties which have
been inadvertently left out, or the annexation description written with sufficient
ambiguity as to create doubt to whether the parcel is part of the City of Bremerton or a
County island. All of the below have been included into the new City wide legal.
1. Annexation 1564 uses a metes and bounds call which does not include an
approximately 25 foot by 225 foot strip of Magnusson Way on the north side of
the roadway west of Perry Avenue.
2. Annexation 1564 calls to southerly margin of County Road No. 27, while
Annexations 3375 and 2641 reference to the centerline of Sheridan Road. As the
two right of ways are not coincident, this potentially leaves the south half of
Sheridan Road, depending on interpretation on the locations of the County road,
from Sanders Avenue to the Perry Avenue Mall in the County.
3. Annexation 2637 calls to the north margin of Sylvan Road, while Annexation
1959 notes all of Olympic Manor. However, the plat only goes to the centerline
of the roadway leaving the north half of Sylvan from Wheaton Way to the west
end of the plat (1320 feet) in County jurisdiction.
4. Annexation 2747 calls to the line of navigability for Kitsap Lake. Annexation
4629 calls to the shore line of Kitsap Lake, leaving an area of the shoreline
between the two annexations to County jurisdiction.
5. Annexation 4500 (Parcel IV) excludes out the railroad line segregating the parcel
and making it non-contiguous with the City limits.
6. Annexation 4493 calls to the northerly margin of We mer Road. Annexation 4033
calls to the centerline of Wemer Road, leaving the northerly half of the right of
way in County jurisqiction.
7. Annexation 1346 calls to the westerly margin of Oyster Bay Avenue. Annexation
calls to the easterly margin of Oyster Bay Avenue, leaving the entire roadway in
County jurisdiction.
8. Annexation 4341 calls to the southerly margin of 1 st Street. Annexation 2339
calls to the centerline 1 st Street, leaving the southerly half of the right of way in
County jurisdiction.
9. Annexation 1627 explicitly excludes out Marion A venue from Arsenal Way to 1 st
Street, and Annexations 4376 and 4327 are to the subdivision line, leaving the
street in County jurisdiction.
10. The original City limits for Charleston and subsequent annexations 2433 and
3951 leave a portion ofSR 304 in County jurisdiction. This is a portion of the
highway beautified with the Gateway project and is now maintained by City
Parks.
11. Annexation 2494 calls to the west line of the plat of United States Navy Yard
Addition to Bremerton. Annexation 1564 calls to the section subdivision line
between Sections 11 and 12, which is not coincident to the same line, leaving a
sliver of property in County jurisdiction.

12. Annexation 1959 calls to the south line of the plat of Sylvan Park Addition.
Annexation 1564 calls to the section subdivision line, which is not coincident to
the same line leaving a sliver of property in County jurisdiction.
13. Annexation 1564 calls to the section subdivision line and annexation 3977 to the
west line of the plat of Femwood. The two lines are not coincident leaving a
sliver of property in County jurisdiction.
14. Ambiguity in annexation 2449 has the annexation on the north side of Kit sap
Way, with annexation 1581 bringing in the adjacent right of way of Kitsap Way.
This leaves a remnant triangular of the northwest quarter of the northeast quarter
of the southwest quarter of Section 15 in County jurisdiction.
15. Ambiguity in annexation 2449 has the annexation on the north side of Kitsap
Way, with annexation 1581 bringing in the adjacent right of way of Kitsap Way.
This leaves a remnant triangular of the southeast quarter of the southeast quarter
of the northwest quarter of Section 15 in County jurisdiction.
