ORDINANCE NO. 5 CJ , 3
AN ORDINANCE of the City Council of the City of
Bremerton, Washington, relating to the vacation of portions of
Alley lying adjacent to former City Hall properties, between
Burwell and 4th Streets and Washington and Pacific Avenues.
WHEREAS, the City initiated a vacation of portions of the alley lying adjacent to
the former City Hall properties, between Burwell and 4th Streets and Washington and Pacific
Avenues; and
WHEREAS, the abutting property owner has agreed to dedicate a new right-of-
way to allow for replacement and re-alignment of the right~of-way.
WHEREAS, the City passed Resolution No. 3028 declaring its intention to vacate
these portions ofthe alley lying adjacent to the former City Hall properties, which resolution also
set a hearing to take public comment or consider written objections to the vacation; and
WHEREAS, a public hearing was held with proper notice on May 16, 2007, in the
City Council Chambers at the Norm Dicks Government Center to take public comment or
consider written objections to the vacation; and
WHEREAS, the City Council has determined that it is in the best interest of the
public to proceed with the vacation; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF BREMERTON, WASHINGTON,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The foregoing recitals are incorporated as if fully set forth herein.
SECTION 2. Vacation. Those portions of the alley lying adjacent to the former
City Hall properties, between Burwell and 4th Streets and Washington and Pacific Avenues, as
described in Exhibit A, which is attached and incorporated herein by this reference, is hereby
vacated to the abutting property owner subject to the following condition:
The abutting property owner shall dedicate a new right-of-way as
described in Exhibit B attached hereto and incorporated herein by this reference,
or as otherwise approved by the City.
The street vacation herein shall be effective upon the recording of a deed dedicating the
new right-of-way.

SECTION 3. Easements. The granting ofthis vacation is subject to no

of this ordinance.
SECTION 5. Severability. If anyone or more section, subsections, or sentences
of this Ordinance are held to be unconstitutional or invalid, such decision shall not affect the
validity ofthe remaining portion of this ordinance and the same shall remain in fun force and
effect.
SECTION 6. Effective Date. This ordinance shall take effect and be in force ten
(10) days from and after its passage, approval and publication as provided by law.
