Re: CPSGMHB Appeal
Dear Mr. Lubovich:
This letter confirms our recent discussion with regard to services to be performed
by our firm on behalf of the City of Bremerton in connection with City's appeal to the
Central Puget Sound Growth Management Hearings Board on the recent amendments to
the Port Orchard comprehensive plan adopted by the City of Port Orchard through
Ordinance No. 042-08. As a matter of routine office procedure, we are writing to
confirm our fee arrangement with you.
We will be for the work we perform on this matter at a ten percent reduction from
our regular hourly rates. These rates currently vary from $475.00 per hour to $190.00 per
hour depending on the attorney(s) involved and $120.00 per hour to $95.00 per hour for a
paralegal, if used, and may be increased from time to time. Although my current billing
rate is $405 per hour I will bill the City on this matter at a rate of$350 per hour. In
addition, we have agreed that the total bill on this matter for attorneys and paralegal fees
will not exceed $18,500.
It is the policy of our firm to bill our clients on a monthly basis, and in the
absence of any agreement or arrangement to the contrary, we expect to be paid in full
within 10 days of billing. Accounts, which are more than 30 days delinquent, will be
charged a late fee of 1 % per month. Our monthly statements will be itemized as to each
general activity.
We may incur out-of-pocket expenses in connection with this matter. In most
cases we will advance nominal expenses and bill you for them at the end of the month.

Any substantial expenses will either be paid by you in advance or billed directly to you
by the consultant, court reporter, or appropriate party.
While we endeavor to estimate as accurately as possible your total expenses and
fees in handling a matter of this nature, we always caution clients that such statements are
estimates only. Our monthly billing statements will serve to keep you advised of the
actual cost of representation.
If the foregoing meets with your approval, please sign and return this letter to me
so that we can begin work on this matter. Please write us if you have any questions about
your fee arrangement.
