SYSTEM IMPROVEMENT AGREEMENT
REIMBURSEMENT AGREEMENT FOR EXTENDED SEWER MAINS
The City of Bremerton, a first class municipal corporation of the
state of Washington, (hereinafter "City") and HERINGTON BUILDERS,
(hereinafter "Constructor"), in consideration of the mutual
covenants herein defined, enter into this agreement for the
reimbursement of cost of said project in accordance with the
following terms and conditions.
a) RCW 35.91.020 and Bremerton Municipal Code 15.01.090 allow
developers constructing City utility system improvements to be
reimbursed from properties which subsequently connect to these
improvements for fifteen years following completeion. The
Contructor has applied for reimbursement pursuant to this statute
and ordinance. In consideration of the construction and dedication
of system improvements pursuant to this agreement, the parties
agree as follows:
b) System improvements subject to reimbursement from latecomers
connecting to said improvements are described as follows:
The Woodland Drive/Fifth Fairway Sewer Extension is 1,276 feet in
length and consists of an 8" diameter sanitary sewer line, seven
manholes, and appurtenances, located in the Southeast Quarter of
Section 8, TownShip 24 N. , Range 1 E.; W.M. , Kitsap County,
Washington and more particularly within the Woodland Drive NW and
Holiday Place NW rights-of-way.
As further shown on Exhibit "A", attached and made a part thereof.

c) The City hereby grants the Constructor the right to recover
Constructor's cost by reimbursing the Constructor from the fair pro
rata share of project costs paid by properties connecting to or
benefitting from the above improvements for a period (15) fifteen
years from the date of dedication of the improvements or the date
the Constructor is fully reimbursed for its construction costs of
$74.994.75 less 15 percent program administration charge retained
by the City. Said payment from City to Constructor shall occur
within sixty (60) days of receipt of payment of connection charges
from each applicant that connects to said sewer main extension.
d) The City has determined that those properties connecting to the
City system improvements described under subsection b) either
directly or through lateral sewer lines, located within the area
depicted in Exhibit "A" attached hereto and incorporated by
reference herein, shall pay Front Footage Fee of $29.39 per front
foot as defined in BMC 15.06.02. KITSAP COUNTY

e) Upon payment of recording costs by Constructor the City shall
promptly file this agreement for recording with the Kitsap County
Audi tor after dedication of system improvement subject to this
reimbursement agreement. ONCE FILED THIS AGREEMENT SHALL BE A LIEN
ON PROPERTIES WITHIN THE BENEFIT AREA DEPICTED AND DESCRIBED IN
EXHIBIT "A" WHICH THEREAFTER CONNECT TO THE SYSTEM IMPROVEMENTS
DESCRIBED IN SUBSECTION b). THIS LIEN SHALL TERMINATE BY OPERATION
OF LAW FIFTEEN YEARS AFTER RECORDING.
