REEL 0943 FR 0308 " SYSTEM IMPROVEMENT AGREEMENT REIMBURSEMENT AGREEMENT FOR EXTENDED SEWER MAINS The city of Bremerton, a first class municipal corporation of the state of Washington, (hereinafter "ci ty"-) and - Department of Veteran's Affairs, (hereinafter "Constructor"), in consideration of the mutual covenants herein defined, enter into this agreement for the reimbursement of cost of said proiect in accordance with the following terms and conditions. - - a)' ,RCW 35.91.020 and Bremerton Municipal Code 15.01.090 allow developers constructing City utility system improvements to be reimbursed from properties which subsequently connect to these improvements for- fifteen years following- completion. The ~ Constructor has applied for reimbursement pursuant to this statute and ordinance. In consideration of the construction and dedication of system improvements pursuant to this agreement, the parties agree as follows: b) System improvements subject to reimbursement from latecomers connecting to said improvements are described as follows: An 8" PVC wastewater sewer beginning at an existing manhole located at the intersection of Holiday Place NW and Ridgeway Circle and terminating at a manhole 300 linear feet east. Located in the Southeast Quarter of section 8, Township 24 N., Range 1 E.; W.M., Kitsap County, Washington. As further shown on Exhibit "A", attached and made a part thereof. c) The City hereby grants the Constructor the right to recover Constructor's cost by reimbursing the Constructor from the fair pro rata share of project costs paid by properties connecting to or ben~fitting from the above improvements for a period (15) fifteen years from the date of dedication of the improvements or the date the Constructor is fully reimbursed for its construction costs of $21,917.38 less 15 percent program administration charge retained by the City. Said payment from City to Constructor shall occur within sixty (60) days of receipt of payment of connection charges from each applicant that connects to said sewer main extension. d) The City has determined that those properties connecting to the City system improvements described under subsection b) either directly or through lateral/sewer lines, located within the area depicted' in Exhibit "A" attached' hereto and incorporated by reference herein, shall pay Front Footage Fee of $39.42 per front, foot as defined in BMC 15.06.02. ONCE FILED THIS AGREEMENT SHALL BE A LIEN ON PROPERTIES WITHIN THE BENEFIT AREA DEPICTED AND DESCRIBED IN EXHIBIT "A" WHICH THEREAFTER CONNECT TO THE SYSTEM IMPROVEMENTS DESCRIBED IN SUBSECTION b).
