RESOLUTION NO. 307 to
A RESOLUTION of the City Council of the City of Bremerton,
Washington, finding that an emergency exists pursuant to BMC
20.10.050(e) requiring an immediate amendment to the City of
Bremerton Comprehensive Plan outside of the annual process regarding
the Bay Vista (formerly called "Westpark") Sub-Area Plan.
WHEREAS, the City passed Resolution Nos. 1730 and 2117 and Ordinance No. 4830
designating blighted areas, and made findings that redevelopment of these areas are necessary in the
interest of public health, safety, morals and welfare of the residents of Bremerton; and
WHEREAS, the City adopted Ordinance No. 4873 designating Westpark as a blighted
area and reaffirmed the City's community renewal program; and
WHEREAS, the City reaffirmed its intention to cooperate with and assist the Housing
Authority of the City of Bremerton (BHA) in redevelopment of the Westpark site, ~nd to provide a
framework for redevelopment in the City's Comprehensive Plan and zoning regulations; and
WHEREAS, the City passed Ordinance No.4917 designating the Westpark site as a
Public Sector Redevelopment Site (PSRS) in the 2004 Comprehensive Plan major update which indicated
that the site possessed significant potential for redevelopment and that it provides a unique opportunity to
benefit the community; and
WHEREAS, the Comprehensive Plan requires that a sub-area plan be prepared for PSRS-
designated properties, which plan must involve the community in its preparation, be consistent with
Comprehensive Plan goals and policies, and contain development standards and design guidelines; and
WHEREAS, in 2007, following extensive community involvement, public hearings and
environmental review pursuant to the National Environmental Policy Act (NEP A) and the State
Environmental Policy Act (SEP A), the City Council passed Ordinance No. 4998 adopting a sub-area plan
for the Westpark site which amended the Bremerton Comprehensive Plan; and
WHEREAS, the BHA has renamed the site and proposed redevelopment project Bay
Vista; and
WHEREAS, the BHA has continued to evaluate the site's opportunities and physical

regulations, and therefore to the City's Comprehensive Plan, are required to enable redevelopment to be
economically viable; and
WHEREAS, in September 2008, the BHA received a $20 million dollar HOPE VI grant
from the U.S. Department of Housing and Urban Development to support redevelopment ofthe site, and
the conditions of that grant require that all redevelopment activities be completed, inclusive of all

Emergency Comprehensive Plan Amendment
WHEREAS, consistent with the Growth Management Act (RCW 36. 70A.l30(2)(b)), the
City has adopted development regulations which limit amendment of the Comprehensive Plan to one time
per year, except when an emergency is found to exist or in other limited circumstances (BMC
20.1O.050(e)); and
WHEREAS, delay in amending the sub-area plan would extend review and permitting of
redevelopment and commencement of construction, which would threaten the viability of the Bay Vista
redevelopment, jeopardize the availability of the HOPE VI grant funds, and perpetuate the blighted
conditions that effect the site and the neighborhood; and
WHEREAS, such delay, loss offunding, and continuation of blighted conditions would
be contrary to the public health, safety, and welfare and such delay would not be in the best interests of
the citizens of the City of Bremerton, therefore constituting an emergency situation pursuant to BMC
20.10.050(e); NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF BREMERTON, WASHINGTON, DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council finds that an emergency condition exists affecting the
Bay Vista site. Immediate action by the City is required to avoid significant threats to the viability of
redevelopment and the availability of grant funding, and to assure and expedite removal of blighted
conditions that affect the site. This emergency warrants an out of cycle amendment of the City's
Comprehensive Plan, consistent with the Growth Management Act and adopted City regulations pursuant
to BMC 20.1O.050( e). The City Council therefore authorizes the processing of an out of cycle
Comprehensive Plan amendment for Bay Vista.
SECTION 2. Severability. If anyone or more sections, subsections, or sentences of
this Resolution are held to be unconstitutional or invalid, such decision shall not affect the validity ofthe
remaining portion of this Resolution and the same shall remain in full force and effect.
SECTION 3. Effective Date. This Resolution shall take effect and be in force
immediately upon its passage.
