and GordonDerr for legal representation

SUMMARY: The City Attorney's Office employs outside legal counsel to assist in the representation
of the City of Bremerton in specialized areas. Morris & Toraday, P.C. assists in representing the City
on land use and related issues. GordonDerr assists in representing the City with issues related to the
overwater boardwalk, water rights issues and related matters. Both firms' hourly rates are reasonable
and these firms are highly specialized in the areas that the City engages them.

FISCAL IMP ACTS (Include Budgeted Amount): Professional Services are currently budgeted in
the City Attorney's budget and the Department of Public Works & Utilities' budget.

RECOMMENDED MOTION: Move to approve the engagement letters with Morris & Taraday,
P.C. and GordonDerr for legal representation and authorize the City Attorney to execute the letters of
engagement in substantially the same form as presented and further authorize the City Attorney to
approve periodic rate adjustments.
