RESOLUTION NO. SO 7~
A RESOLUTION of the City Council of the City of
Bremerton, Washington, approving an agreement between the
Washington State Department of Transportation (WSDOT) and the
City of Bremerton regarding the acquisition of right-of-way for the
Manette Bridge.
WHEREAS, pursuant to RCW 47.17.960, WSDOT is responsible for
maintenance, repair and replacement of the Manette Bridge; and
WHEREAS, WSDOT is currently planning the replacement of the structure; and
WHEREAS, the underlying right-of-way is vested with the City of Bremerton;
and
WHEREAS, the City needs to assist with the acquisition and accept title for the
purchase of private property for right-of-way and to petition the DNR for a grant of right-of-way
across state lands for the replacement bridge; and
WHEREAS, all costs associated with the both the property purchase and DNR
lease are the responsibility ofWSDOT, City costs are limited to time spent by personnel
assisting with the coordination of said work; NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF BREMERTON, WASHINGTON,
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. City Council hereby approves an agreement with WSDOT for the
acquisition and acceptance of right-of-way and a Department of Natural Resources (DNR) lease
for the Manette Bridge.
SECTION 2. The Mayor is authorized to finalize and execute the proposed
agreement with substantially the same terms and conditions as presented.
SECTION 3. Severa b ilitv. If anyone or more sections, subsections, or
sentences of this resolution are held to be unconstitutional or invalid, such decision shall not
affect the validity of the remaining portion ofthis Resolution and the same shall remain in full
force and effect.
SECTION 4. Effective Date. This Resolution shall take effect and be in force
immediately upon its passage.
