SUMMARY: Kitsap Bank was a lender to Ron Burley Construction, Inc. (Burley) to construct
infrastructure and single family residences in a development known as Makayla Heights located on
Makayla Avenue in Bremerton. Burley defaulted on its loan to Kitsap Bank and Kitsap Bank is now
the owner of certain properties in Makayla Heights. Burley had not completed some of the work
items necessary to complete Makayla A venue and accompanying infrastructure. The City and Kitsap
Bank desire to work in cooperation to complete the work items necessary to finish the improvements
on Makayla Avenue.

FISCAL IMP ACTS (Include Budgeted Amount): City will receive $30,000 from Kitsap Bank to
support the construction of the agreed utility improvements. This payment will cover material costs
and asphalt restoration expenses. Labor will be provided by the Stormwater and Water Utilities.

RECOMMENDED MOTION:
Move to approve the Agreement between the City of Bremerton and Kitsap Bank for the completion
of improvements on Makayla Avenue and authorize the Mayor to finalize and execute the agreement
with substantially the same terms and conditions as presented.
