PUBLIC HEARING
6A - ORDINANCE NO. 5055, VACATING A PORTION OF THE ALLEY BETWEEN BURWELL
STREET AND EXISTING MID-BLOCK ALLEY (#AB08-187): City Engineer Michael Mecham
provided background information on the proposed vacation. As part of the redevelopment of the
former City Hall properties, the City has initiated the vacation of a portion of the alley to allow the
current owner of the property, HCK2, LLC, better use of the site. This date has been scheduled
for a public he~ring in accordance with state law and the Bremerton Municipal Code on the
proposed ordinance vacating the subject property. In accordance with BMC 11.20.080 (d), no
compensation is required. A PowerPoint@ presentation was made to provide further details.
The Public Hearing was closed after there were no comments or questions from the public.
05:41 :22 The Main Motion was made and seconded. Council then began their discussion...
Mr. McConnell asked if it would be a one-way alley. Mr. Mecham responded yes.
Mr. Brockus asked if this action is approved, will it prevent most tractor trailers and delivery trucks
from going through the alley. Mr. Mecham said it was correct that some bigger trucks would not
fit in the alley and would have to back in and then back out; but the biggest concern was regarding
use by the garbage trucks but that issue was resolved after conversations with Terry Bickel,
District Manager for VVaste Management who said they could make it work. The other concern
addressed was regarding use by the utilities, but most problems were resolved after a majority of
\
the utilities were moved to the westerly side of the alley.
Mr. Brockus asked for confirmation that this action was requested by the developer so they could
add balconies. Mr. Mecham stated yes. Mr. GerinQ questioned the height of the balconies over
the easement area. Mr. Mecham replied that the balconies were planned for the 2nd floor. But Mr.
Brockus expressed concern that there are no guarantees, and that the developer could change
their mind about the balconies and instead construct the building right up to the line. Mr. Mecham
stated that was correct.
05:44:30 M/S/C (Arends/Robinson) Move to pass Ordinance No. 5055 for vacating a portion of
alley between Burwell Street and the existing mid-block alley, adjacent to the former City Hall
Properties.
Voted in favor of Motion: McConnell, Runyon, Robinson, Arends, VVofford, Maupin
Voted opposed to Motion: Brockus, Shepherd, Gehring
Motion carried: 6-Yes; 3-No
GENERAL BUSINESS
7A- ORDINANCE NO. 5054, AMENDING CHAPTER 15.06.040 OF THE BREMERTON
MUNICIPAL CODE (BMC) AND EXTENDING THE SUMMER SEWER BILL DISCOUNT TO ALL
RESIDENTIAL CLASS CUSTOMERS (#AB08-188): Public VVorks & Utilities Director J
Phil Williams explained that this proposed ordinance amends BMS Section 15.060.040 to extend
a discount to Single Family Residential and duplex, customers of the City's Sewer Utility that bases

summer sewer bills on wintertime average water consumption. This proposed change in the BMC
would extend that discount to all other residential customer classes. It would apply to
condominium complexes, apartment buildings, and other residential projects. The rationale for
extending the discount initially was to prevent customers from being charged on their sewer bill for
irrigation water that does not end up in the City's collection and treatment system. The discount
also serves as additional incentive for residents to keep their lawns and landscaped areas green
and aesthetically presentable. These reasons apply equally to all residential customers regardless
of customer class.
05:49:25 The Main Motion was made and seconded. Council then began their discussion...
Mr. McConnell after pointing out missing language in a section of the ordinance, it was
determined by City Attorney ROQer Lubovich that an incorrect version of the proposed ordinance
was before the Council.
05:54:35 A 5-minute recess was taken while copies of a corrected first page for proposed
Ordinance No. 5054 were distributed to the Council Members...
06:00:245 The meeting was called back to order, as discussion by the Council continued...
Mr. Lubovich read the section with the corrected language, and explained the differences.
Mr. Shepherd asked if there is any other discount besides the retail wastewater rate for single
families. Mr. Williams responded yes, the discount would be extended to any customer that is .
either residential single-family, duplex, or multi-family property - it's just that the discount would be
based on a slightly different number.
06:11 :31 M/S/C/U (Brockus/McConnell) Move to pass Ordinance No. 5054 amending BMC
Section 15.060.040 extending the summer sewer bill discount to all residential customer classes.
