between R.P Apartments LTD (hereinafter "Grantor")' and
BREMERTON, a Washington municipal corporation of Kitsap
Washington (hereinafter "Grantee").

WITNESSETH that Grantor for and in consideration of mutual benefits derived
and/or other valuable consideration, receipt (If which is hereby acknowledged by Grantor,
do by these presents grant, bargain, sell, convey, and confirm unto Grantee, its successors
and/or assigns, an easement for water utilities, with necessary appurtenances, over,
through, across and upon the following described property situated in Kitsap County,
Washington, more particularly described as follows:

Grantee shall have the right, without prior institution of suit or proceeding at law, at
times as may be necessary, to enter upon the above-referenced property and immediately
adjacent incidental areas with the necessary equipment for the purposes of altering,
installing, operating, maintaining, extending, constructing, repairing, and reconstructing
the utility/utilities, or making connections to that system, without incurring any legal
obligation or liability; provided, however, that the private improvements existing within
this easement area and the immediately adjacent incidental areas shall not be disturbed. or
destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good
a condition as they were immediately before the properties were entered upon by the
Grantee.
Grantor shall retain the right to use the surface of this easement, including the
immediately adjacent incidental areas, so long as that use is not inconsistent with and does
not interfere with the rights and uses granted to Grantee in this document. Under no
circumstances shall Grantor place any cement, concrete, structure, trees, large shrubs or
any other objects on the property described in this easement or the immediately adjacent
incidental areas in a manner that would interfere with Grantee's use ofthe easement.
This easement shall be a covenam running with the land, and shall bind Grantor's
successors and assigns and all future owners of the real property affected by this easement.

A 15' wide easement for utilities lying over, under and across the following described
centerline, having 7.5 feet lying on each side of said centerline.
Commencing at the northwest comer of Section 26, Township 25 North, Range 1 East, W.M.
Kitsap County, Washington. Thence South 880 20' 20" East along North line of said Section
26 a distance of 175.28 feet;
. Thence leaving said North line South 0009' 15" West a distance of 125.20 feet to a point on
the North property line and true Point of Beginning;
Thence South 150 21 '38" East a distance of 88.88 feet; Thence South 370 53' 38" East a
distance of 7.25 feet; Thence continuing South 370 53' 38" East a distance of 16.50 feet;
Thence South 00 48'40" East a distance of 38.50 feet; Thence South 200 58' 39" East a
distance of 16.99 feet to point "X"; Thence South 52053' 17" East a distance of 14.00 feet to
a connection with an existing 6" ductile iron water line and the terminus ofthis easement.
Together with a 15' wide easement commencing from above mentioned point "X", South 350
37' 44" West a distance of7.34 feet; Thence South 680 20' 11" West a distance of8.00 feet;
Thence North 790 02' 51" West a distance of 18.29 feet; Thence South 26049' 17" West a
distance of 5.22 feet to a connection with an existing 6" ductile iron water line and the
terminus of this easement.
