the City of Bremerton to support a broad range of activities to prevent and control crime based on
our own local needs and conditions. These needs are to purchase audio and video equipment for
recording and collecting events that take place in Department interview rooms. Funds will also
purchase ancillary equipment for a multi-purpose incident command vehicle needed in times of
disasters, active shooters, terrorist events, crime scenes and vehicle accidents. The grant is from
the Department of Justice, and no matching funds are required of the City. The total grant amount

COUNCIL SUMMARY
DECLARA TION OF EMERGENCY -
OB-l FORCEMAIN
Summary
In early June, a catastrophic failure of the forcemain from Pump Station OB-l (the pump
station below the Oyster Bay Inn) occurred when a section of the 40-year old Cast Iron
Forcemain failed. Staff replaced the failed section and identified that the interior of the
forcemain had been damaged over time from excessive scour. This damage reduced the
thickness of the bottom of the pipe from approximately Yz-inch to less than lI8-inch in
sections of the pipe still in service. An ultrasonic thickness tester was purchased and staff
has conducted spot testing of the forcemain at various suspect locations along the length
of the 3,700-foot long forcemain. At this time, it appears that the scour damage is
localized and limited to the segment north of Kitsap Way and a short section at a manhole
near the City Maintenance Shops on Oyster Bay A venue. Engineering Staff are currently
developing plans and specifications for an emergency repair which will replace the
majority of the piping within the pump station and will replace and cure-in-place line all
piping from the pump station to the south side of Kitsap Way on Oyster Bay Avenue.
The emergency work will also include replacing the failing section of pipe adjacent to the
City Maintenance Shops on Oyster Bay A venue. These repairs must be expedited since
the operating forcemain is in jeopardy of repetitive failure; therefore, staff recommends
that City Council approve the resolution declaring an emergency to accomplish the work
in the most expedient method possible. The City will be responsible for bypass pumping
and will purchase pipes, valves and other items with long delivery lead times. A
contractor will be retained for the remaining construction using either the City's or the
Association of Washington Cities' Small Works Roster to identify potential contractors.
Fiscal Summary
A formal cost estimate has not been made for this work, as the scope is evolving;
however, it is anticipated that the emergency repairs will cost on the order of $l50,OOO.
This project is not specifically included in the CIP or budget; however, sufficient funding
exists in the Wastewater Fund Budget under Substandard Main Replacement.

The Statute that enables the City to waive bid laws is RCW 39.04.280(1)(c).
The tern1 "emergency" is defined by statute to mean unforeseen circumstances beyond the
control of the municipality that either: (a) present a real, immediate threat to the proper
performance of essential functions; or (b) will likely result in material loss or damage to
property, bodily injury, or loss oflife, if immediate action is not taken. RCW 39.04.280(3)
Certain emergency situations justify the letting of a contract without following the bid
req uirements:
Exceptions are sometimes made to the rule that when so required by statute or charter,
municipal contracts must be let under competitive bidding. In case of an emergency,
where it is essential to the health, safety, or welfare of the people that immediate action be taken,
the requirement may be dispensed with.
RCW 39.04.280(1)(c) specifically authorizes a municipality to waive competitive bidding
requirements for purchases "in the event of an emergency." In such a situation, the person
designated by the governing body to act in the event of an emergency may declare that an
emergency situation exists, waive competitive bidding requirements, and award all necessary
contracts on behalf of the city to address the emergency. If a contract is awarded without
competitive bidding due to an emergency, written findings of the existence of an emergency
must be made by the governing body or its designee and entered into its record no later than two
weeks following the contract's award.
Several first class city charters also provide that the city may forego bidding procedures in the
event an emergency exists.
MRSC also recommends checking with the State Auditor's Office before declaring the
emergency is also recommended. If the auditor's office agrees that a particular factual constitutes
an emergency situation, that does not guarantee that unhappy contractors will not sue, saying
there was no emergency, but it should prevent a possible negative audit finding.
