Phil Williams
Director of Public Works
City of Bremerton
3027 Olympus AVE
Bremerton WA 98310
Dear Mr. Williams:
The current Comprehensive Solid Waste Management Plan (CSWMP) was completed and
adopted by all participating parties (Cities, Tribes and County) in 1999. RCW 70.95 requires
periodic review and revision of solid waste management plans. Public Works is proposing to
begin this process. Funding for the CSWMP update will come from solid waste reserve fund
earmarked for planning purposes.
RCW 70.95.080 allows for cooperative development of solid waste management plans, and
encourages regional solutions to solid waste issues. In the past, Kitsap County Public Works,
with concurrence from the cities and tribes, has been the lead agency for development of a
regional solid waste management plan for Kitsap County. We are prepared to continue
coordinating solid waste planning efforts, with the support of both the cities and tribes. Cities
have the option of developing their own plan if they do not choose to be part of a coordinated
regional solid waste management plan. The requirements for solid waste management plans
are outlined in Chapter 70.95 RCW.
Participation by the City of Bremerton in the development of the CSWMP update for the County
is important, as this plan impacts the city for the next 10 years. We are requesting that an
Interlocal Agreement indicating the City of Bremerton's intent to continue to be part of this
regional planning effort be executed. Kitsap County is in the process of developing this Interlocal
Agreement and will forward for City Council approval.
I look forward to the upcoming City Council meeting to discuss this issue. If you should have any
questions in regards to the CSWMP update process or solid waste questions in general, please
call 360-337-5784.
Sincerely,
Dean W. Boening
Solid Waste Planner

MEMORANDUM
June 8, 2007
TO: Solid Waste Planners
FROM: Solid Waste & Financial Assistance Program Management Team
SUBJECT: Solid Waste Plans and Interlocal Agreements
Ecolo'gy's Guidelines for the Development of Local Solid Waste Management Plans and Plan
Revisions, December 1999 (guidelines), based on our interpretation ofRCW 70.95' and RCW
39.34, require the submittal of interlocal agreements from all participating jurisdictions, with any
preliminary draft Comprehensive Solid Waste Management Plan (plan).
RCW 39.34.080 states that an interlocal agreement".. .shall set forth fUlly the purposes, powers,
rights, objectives, and responsibilities of the contracting parties." Ecology interprets this to
include the planning process, not only implementation. The distribution of powers and
responsibilities in the planning process are to be included in the interlocal agreement, therefore,
the agreement is to be executed before beginning the planning process. The execution of this
agreement prior to entering into a planning endeavor will provide a means for conflict resolution
and a more streamlined planning process. In addition, RCW 39.34.050 states that an interlocal
agreement is to be submitted and approved by "an officer or agency of state government" prior to
its "entry into force". Based on this statement, interlocal agreements must be submitted to
Ecology with the preliminary draft plan at the latest.
The minimum requirements for a plan in RCW 70.95.080 also require that local jurisdictions
enter into an interlocal agreement to either forfeit or define their participation in the planning
process if they are to adopt the county plan. Otherwise, the local jurisdiction is to develop and
adopt its own plan. The planning guidelines also state that responsibilities specific to the
planning process are to be addressed, in the contract.
In order to effectively conduct the planning process, the jurisdictions involved must have clearly
defined responsibilities and involvement in the process. Therefore, Ecology will require all
county preliminary draft plans to be submitted with an executed interlocal agreement from all
jurisdictions discussed in the plan. It will be the responsibility of regional planners to ensure that
county representatives are informed of this requirement, and that copies of these agreements are
included upon submittal of any preliminary draft plan. It will also be the duty of regional
planners to return, unaccepted, any draft plan submittal that does not contain the required
contracts.
