CUTTING LINE AGREEMENT
'fH/.S CUlTING L:i1.REE~ (hereinafter "Agreement') is made and entered into on this
~ day of 2008 by and between the City of Bremerton Department of Public
Works and Utilities, 30 7 Olympus Drive, Bremerton, Washington (hereinafter the "City"), and Ueland
Tree Farms, LLC, 16419 Maplewild Avenue SW, Burien, WA 98166 (hereinafter "UTF").
The following line located along the common property boundary described as:
the North Half ofthe North-South Centerline ofthe Northeast Quarter, Section 25,
Township 24 North, Range 1 West, W.M.
is hereby accepted as a valid cutting line boundary for the purpose of harvesting timber proposed by the
City;
1. The said line has been established and marked on the ground solely for the purpose of
establishing a line, up to which each party hereby may cut timber, and is not intended to mark or
establish by adverse possession, agreement, acquiescence, estoppel, or otherwise, the true
boundary between the adjoining parcels of land owned by the parties hereto.
2. The line has further been marked on the ground with survey stakes and plastic flagging, and/or
blazed and painted trees.
3. The parties hereby, their heirs, successors, and assigns, grant each to the other the right and
permission to cut timber up to said line.
4. This Agreement may be rescinded by mutual agreement of the parties hereto or by either giving
to the other thirty (30) days notice in writing (which notice shall be served either personally by
the rescinding party on the other or by mailing to them at the last known post office address by
certified mail, return receipt requested) after the rescinding party has taken appropriate and
suitable action to determine and establish the true boundary between the adjoining parcels of
land.
5. In the event the true boundary is determined and established between the adjoining parcels of
land owned by the parties hereto, and it is revealed thereby that either party has cut timber which,
in fact, belonged to the other, such party shall pay to the other the fair price of the timber so cut
prevailing at the time it was cut, as determined by the appropriate Washington State Department
of Revenue Stumpage Values and/or negotiated by the parties hereto. This clause shall be invalid
ifnot acted upon within five (5) years of the date first designated above.
The attached exhibit shows a graphical representation of the above mentioned line, and any associated
survey data used to establish such line.
