HEARING CONSIDERATIONS
BMC 11.20.120 sets forth issues that the City Council needs to determine at the
conclusion of the Vacation Hearing. These issues and the staff position are:
1. Whether the street, alley or portion thereof is no longer required for public
use and vacation of the described portion will better serve the public good.
Staff Position:
Public use of the intersection and portions of Chester and 16th will remain, but re-
routed.
2. Whether the vacation is consistent with the City Comprehensive Plan.
Staff Position:
The proposed vacation does not conflict with the Comprehensive Plan.
3. Whether continued use of the proposed vacation as a public way is not of
such public benefit as to justify the costs of maintenance.
Staff Position:
The improvements will reduce the City's maintenance responsibility in this area.
4. Whether substitution of a new and different thoroughfare would be more
useful to the public.
Staff Position:
The new thoroughfare will be of better use to the public.
5. Whether conditions may so change in the future as to provide a greater
public use or need than presently exists.
Staff Position:
Public use of the area will remain in the future.
6. Whether objections to the proposed vacation are made by owners of
private property abutting the same.
Staff Position:
Olympic College is the only abutting property owner.
SHORELINE ACCESS
This portion of right-of-way does not provide shoreline access.

RE: Final Staff Report: Vacation of a portion of 16th Street and Chester Avenue
Dear Mr. Fridriksson:
We are in receipt of the final staff report and cover letter concerning the vacation of a portion of
16th and Chester Avenue relluested by Olympic College dated February 6, 2008. This request is
to allow an upgrade to the intersection of the two sh'eets, improving functionality and
appearance through realignment and construct a new campus entry drop-off lane and entry
plaza.
We have reviewed the six Hearing Considerations outlined in the report and concur with the
staff findings. The only exception we take to the report is the requirement for compensation.
We respectfully request the Council consider a waiver of the $74,160 in compensation identified
in the report in accordance with BMC 11.20.140 (E).
The reason for waiving the compensation for loss of City right-of-way area is quite
simple: The project is in the "public's interest and advantage", in accordance with
Bremerton Municipal Code. The public will receive a new roadway, sidewalks, and
street lighting free of cost. The City will also have less surface area to maintain in the
future, saving taxpayer dollars.
The City currently has a public right-of way that COlU1ects 16th Street to Chester Avenue.
The roadway is aged and ready for repairs. The public sidewalk on the north and east
sides are far from meeting accessibility standards, and handicapped accessible curb
ramps are non-conforming where they exist at all. In addition, the current sh'eet lighting
does not meet current Public Works standards.
RECEIVED
FEB 1 2 2008
ENGINEERING ~IVISION
At the completion of the project, the public will receive a new roadway that connecting
16th Street to Chester A venue with over 4,900 square feet less pavement to maintain in
the fuhue, plus new street lighting that meets City standards.
The public will also benefit from 670 linear feet of new, accessible sidewalks plus four
new handicapped accessible curb ramps at the intersection of 16th Street and Broadway
Avenue. TIle City will also have 50 linear feet less sidewalk to maintain.
TIle College, with State assistance, is providing all funds for design, engineering, and
construction -- over $ 25 million dollars. The College will also pay the City all required
plan review and inspection fees.
The College is not requesting any direct funds from the City for this project.
The proposed new campus entry project is not required by any City mandate. It is
offered as a fully funded infrastructure improvement for use by the citizens of
Bremerton and shldents of Olympic College.
The College is prepared to provide a covenant stating that the City shall be compensated
for the vacated area at the time of any future sale or lease of the property, in accordance
with BMC 11.20.140. (E).
Thank you for your assistance in this process. Please confirm the tentative date for the first
hearing at City Council of February 13, 2008.
Sincerely,
p~~

COUNCIL SUMMARY
AMENDMENTS TO CHAPTER 2.88 BMC
SUMMARY: We have been using chapter 2.88 of the BMC as written for several years.
As we have applied the section of the BMC we have realized there are some revisions to
this Chapter that would make the administration of this chapter much easier. The
following is a summary of the revisions.
1. The number of committee members has been changed from seven (7) to three (3).
In the past it has been difficult to find seven people to serve on this committee.
When seven people were appointed, it was difficult to have a quorum attend at
each meeting.
2. In the past the Human Resources department has taken the staff lead in this
committee. The revision proposes that the Department of Public Works and
Utilities take the staff lead. This makes much more sense because Public Works
and Utilities typically construct the handicap facilities, maintain and repair these
facilities and usually respond to citizen concerns.

Scope of Services
The City of Bremerton (City) has requested that Soren Northwest, Inc. (SNW) provide lobbying
and consulting services before the Washington State Legislature and Executive Branch. The
City wishes SNW to help design, implement and direct a successful legislative government
relations program in Washington State leading to the redevelopment of the downtown area,
revitalization of its neighborhoods, enhancement of its tax base and revenue streams and to
provide greater opportunity to participate in State and Federal grants programs. These efforts
will include advising the City's management as to the legislative process, helping design, and
assisting them in supporting positive measures and generally lobbying the State legislative and
executive process and its agencies.
The first step of a legislative program is to protect those resources, rights and powers already
established in current law. A major part of any lobbying program is to not lose rights or
privileges. The goal of the lobbying program is to secure for the City the protection of current
law and the opportunity for expansion of rights and responsibilities that it seeks.
SNW will also monitor and report on legislative activities related to the City's projects. These
activities would include meeting with legislative members, staff and appropriate State agency
staff as well as the Association of Washington Cities' staff to help shape legislative requests
related to the City's many infrastructures, human service and management initiative.
In planning for a constructive legislative program, SNW will help the City develop a positive
State legislative agenda, report to the City on a regular basis, as desired, and meet with its
management and consultants as needed.
Public Disclosure: SNW will be responsible, with the assistance of the City, for the accurate
and timely filing with the State Public Disclosure Commission (PDC) of the annual L-I
registration form and the monthly L-2 forms. The City shall be solely responsible for the timely
filing of the annual L-3 report required of a lobbyist's employer.
Liaison. The City shall appoint a liaison person to whom SNW shall report, submits forms,
reports and billings and from whom SNW will receive instructions. .
Conflict of Interest. It shall be the responsibility of SNW to identify and discuss with the City
any potential conflicts of interest in terms of legislative priorities or action required or
contemplated by other entities represented by SNW.
Duties of SNW. The duties of SNW are provided as follows:
1. SNW, to the best of its ability, shall attempt to pass, stop or amend legislation as desired
by the City, as well as to at all times build a positive legislative presence for the City to
benefit future legislative efforts.
2. Attend meetings with City personnel as reasonably requested.

3. Meet with the City legislative delegation members or staff and local government elected
officials and staff as reasonably requested.
4. Meet with such legislators, legislative staff and State administrative personnel as shall be
necessary or advisable for the timely and successful completion of SN\V's lobbying
responsibilities.
5. Attend meetings of and work with other organizations and coalitions that would benefit
the City's legislative program.
6. Assist the City in the distribution of materials to appropriate parties.
7. RepOli to the City in such manner as is mutually agreed upon by SNW and the City.
8. Complete all the work and assignments, in a manner mutually agreed to.
9. Help coordinate the application, successful competition and receipt of State grants to
fund capital projects desired by the City, including $4 million budgeted for the
