SUMMARY: City Council previously authorized an agreement to enter with a coalition of
approximately 30 Cities to appeal the NPDES II permit for stormwater discharge. The City at that
time contributed $8,000 to the coalition for legal fees. Due to the complexity of the appeal, additional
fees are needed. An estimate was sent to coalition members indicating an additional $20,000 froin
each member is needed to complete the appeal to the Department of Ecology Board of Appeals.

FISCAL IMP ACTS (Include Budgeted Amount): $20,000 would be paid from the Storrnwater
Operations Budget for the Engineering Division. Funds are available in Stormwater Operations
Professional Services budq €t -+Or ZOOt.
