WAY USE (#AB07-224): Michael Mecham, City Engineer, stated that Chapter 11.02 of the
Bremerton Municipal Code discusses the issuance of right-of-way use permits. The proposed
amendment emphasizes and clarifies the need for traffic control plans in construction areas of City
streets and clarifies the language concerning deposits and performance bonds.
There were no comments from the public.
Mr. Shepherd provided a specific example to find out if a citizen applied for and obtained a Work
Permit, would the citizen also need to obtain a separate Right-of-Way Permit to use the right-of-
way for parking a truck containing materials during the project. Mr. Mecham stated yes.

11.02 of the Bremerton Municipal Code.
6B - AGREED ORDER WITH WASHINGTON DEPARTMENT OF ECOLOGY REGARDING
FORMER CHEVRON PROPERTY (#AB07-225): Phil Williams, Public Works & Utilities Director,
apologized for the late addition of this item, but explained that the City just recently received the
final Agreed Order from the Washington Department of Ecology for conducting a remedial
investigation & feasibility study and interim action plan in order to develop a final clean-up action
plan of the former Chevron property. He added that this item was expedited to the agenda at the
request of the Department of Ecology.
There were no comments from the public.
Mr. McConnell asked if the previous studies done by Chevron being considered in this agreement
or is this Order a repeat of what they have already done. Mr. Williams responded no, they "build
on it" but provided details to further explain.
Mr. Shepherd stated that he would be voting in support of this item tonight, but still expressed his
concerns with this project due to a lack of surety by the State. Mr. Williams understood the
concerns, but believed that the City had to start somewhere, and added that there have been
positive dealings with the Department of Ecology in the past.
Mr. Gehrina agreed with Mr. Shepherd's concerns, but he pointed out that this was an interim
action and understood the importance of this project to the community.
Mr. Brockus also agreed with his fellow Council Members, and asked Mr. Williams to expound on
the source of additional funding support that was recently offered by the Legislatures.
Ms. Priest and Mr. Maupin expressed their reasons for supporting this project.
Mr. Wofford noted that the agreement required a "public participation plan" and asked if the City
had one in place. Mr. Williams stated there is a draft of a plan, but it has not yet been finalized.
