SUBJECT: Settlement Agreement and
Release between the City of Bremerton and
Scott Alexander and Daryl Matheny
Committee Meeting Date: July 11, 2007
COUNCIL MEETING Date: July 18, 2007
Department: Park & Recreation
Presenter: Wyn Birkenthal
Phone: 473-5752
SUMMARY: The City and Scott Alexander and Daryl Matheny (Professionals) are parties to an
agreement for professional golf services at Gold Mountain Golf Complex. The agreement requires
that the Professionals collect greens fees on behalf of the City. Most of the greens fees are collected
by credit card. Historically the Professionals have remitted 100% of the greens fees to the City
without deducting related credit card fees. The proposed Settlement Agreement and Release provides
for reimbursement to the Professionals of credit card fees related to greens fees from 2002 through
2007 at Gold Mountain Golf Complex.
ATTACHMENTS: Proposed Settlement Agreement and Release
FISCAL IMPACTS (Include Budgeted Amount): Expenditure of$95,938.14 for credit card fees
from 2002 through 2006. Payment for 2007 credit card fees is estimated to be approximately
$40,000. This payment will be made from the Gold Mountain Golf Fund in 2007 and is not
currently a budgeted expenditure. A 2007 budget amendment of$136,000 is required to cover the
prior period amounts and the anticipated 2007 fee settlements. Funding will be from the Gold
Mountain Golf ending fund balance.
