Re: File No. B-431
Dear Ms. McCluskey:
puget Power is returning the previously executed Easement
for the property leased by the Kitsap County Square Dance
Club. The hold harmless paragraph added by the City is
unacceptable.
In order to protect the property and tenant better, we would
ask the City to reconsider puget's Easement, without changing
the indemnity language. We are there to benefit the property
and its user. We feel the City is asking puget Power to
accept undue liability with its hold harmless addition.
The existing lines were placed in good faith to serve the
property, without an easement. The permanent placement
of a mobile home by your tenants under our primary lines
is not against the State law, but is unacceptable to Puget
Power from a liability standpoint. puget Power is proposing
to relocate the existing facilities; however, to protect
our right to the new location from any possible future re-
location due to encroachment of the lines, the Easement
would make our rights enforceable and Puget Power would
be reimbursed for any further moves.
puget Power is not offering any consideration for the Easement
since the proposed relocation of existing facilities is
at no cost to the City or it's tenant.
Please resubmit our request before the Council. If anyone
should have questions, please contact Judy Sleasman at 478-7606.
Thank you for your assistance.
Sincerely,

RE: Puget Power easement
I would suggest we proceed with the easement originally offered
by Puget Power. I think Ms. Harris is correct that a relocation
has been caused by activities of our tenant and a relocation to
make the area safer for occupancy at no expense to the City is
not unreasonable.
I would again request that you move Bill Duffy off the dime and
have something resolved concerning our continued leasing of this
property at no expense to the squaredance club. I recently
passed by this area on th~ Memorial Day weekend and it appeared
that the squaredance club was having some sort of recreational
vehicle convention. There must have been thirty recreational
vehicles parked on the property with people also camping in tents.
The property being used was far in excess of that given by
original lease. Continued use by the squaredance club of this
property is, in my opinion, illegal and unconstitutional and
should be terminated immediately. Thank you for your help in
