by and between the City of Bremerton, a municipal corporation, hereinafter referred
to as "Grantor," and Charles C. Haselwood and Joanne L. Haselwood, husband and wife,
hereinafter refereed to as "Grantees."

RECITAlS:
WHEREAS, title to the property legally described in Exhibit "A" attached hereto
and by this reference made a part hereof as though fully set forth', herein, is vested
in Grantor; and
WHEREAS, Grantees are desirous of obtaining an easement over, through and across
said property to facilitate ingress and egress and to locate utilities to property
which is described in Exhibit "B" attached hereto and by this reference made a part
hereof as though fully set forth herein; and
WHEREAS, Grantor is willing to convey anon-exclusiva easement across the real
property legally described in Exhibit "A" for that purpose; now,;.therefore
fOR AND IN CONSIDERATION of the mutual promises and benefits contained herein,
Grantor and Grantees do hereby agree and covenant as follows:
1. GRANT or EASEMENT: Grantor grants to Grantees an easement to facilitate
ingress and egress and to extend utilities to their property. The easement is over,
through ana, across the ~rope~tt Beicribed in Exhibit "A."
2. HOLD HARMLESS: Grantees he~eby agree to save harmless and defenfi Grantor
from all claims and liability due to the negligent acts, errors or omissions of
Grantees, their agents and/or employees. Grantor shall not be liable to Grantees, or
any other party, for any claim whatsoever arising in connection with this Agreement.
3. MAINTENANCE: Grantees assume all responsibility for the construction and
maintenance of the road to be constructed on this easement. Grantorshall not be
obligated in any respect to improve or maintain any facilities located on the ease-
mente In the event Grantor is dissatisfied with the condition of said improvement,
Grantor shall notify Grantees who shall make such improvements as are required
immediately.
4. GOVERNING LAW: The place of making this Agraement shall: be deemed to be the
State of Was~ington, and the legal rights and obligations of the parties hereto shall
be determined in accordance with the laws of the State of Washington.

5. JURISDICTION AND VENUE: In the event that any suit or action shall be brought
in connection with any of the terms and conditions of this Agfeement, the parties hereto
hereby agree that jurisdiction and venue of any such suit or action shall properly lie
in Kitsap County, Washington.
6. SEVERABILITY: In the event that any section, or any part of any section, of
this Agreement shall be declared invalid by a court of competent jurisdiction, said
holding shall have no effect upon the remaining sections of this Agreement, which
shall remain in full force and effect.
1. ENTIRETY: This Agreement constitutes the entire agreement and understanding
between the parties hereto. There are not other agreements or understandings, either
written or oral, which modify or have any effect upon this Agreement.
IN WITNESS WHEREOr, this Agreement has been duly executed by the parties hereto,
to be effective on the day and year first above written.

THAT PORTION of the West quarter of the Southeast quarter of the Northeast quarter
of Section 21, Township 24 North, Range 1 East, W.M. lying easterly of Union Avenue
and southerly of the following described line:
BEGINNING at the Southeast corner of the Northeast quarter of said Section 21;
thence North 88049'33" West along the South line of said subdivision 932.31 feet;
thence North 1010'27" East 30.00 feet tb the True Point of Beginning of the line
herein described; thence westerly along a curve to the left with a radius of 222.52
feet, the center of which bears North 1010'27" East from the initial point thereof,
for an arc distance of 69.92 feet to a point of tangency; thence North 70049'33"
West 90.00 feet more or less to the easterly right-of-wa~ line of Union Avenue and
the terminus.

TATEMENT AND REQUIREMENT FOR COUNCIL ACTION:
Chuck Haselwood has requested the City provide an easement across its property
for the mutual benefit of both parties. A road has been constructed and is
presently in use (see attached map) for which an easement has not been granted.

Subject: Proposed Haselwood Easement
I cannot check the Easement without a map and survey. However, the
description appears to be located properly on the attached drawing.
It appears that the road across City property has already been constructed
however, the last time I was there, the road was dirt.
The Easement gives all the people listed on the document an Easement across
everyones property including the City.
I have questions that should be answered:
1. Does the City want an Easement across Haselwood's and everybody
else1s property?
2. Who is going to maintain the road?
The document does not mention maintenance or construction.
I suggest that we give everybody an Easement across City property and forget
the rest.

RE: HASELWOOD ET AL EASEMENT
In response to questions raised at the Council meeting of September 3, 1986,
we submit the following.
Mr. Haselwood is out of town and has authorized me to represent him in this
matter and to commit him to the statements made below. The request made of
the City of Bremerton is simply to grant an easement for road and utility
purposes so that improvements may be constructed thereon. This is the only
request made of the city. The city is not asked to participate in funding
any improvements nor will they be asked to participate in any sort of main-
tenance of improvements. We are asking for no other consideration than to
grant an easement.
I have enclosed a sketch which shows the proposal. The area colored pink
is City of Bremerton property requested for easement. It encompasses
approximately 6,600 square feet or about .15 acres. In return the city
would be granted an easement by other parties totalling approximately
62,400 square feet or about 1,43 acres.
The subject of annexation was also raised at the meeting of September 3,
1986. Although we don't see a great degree of relevancy between the ease-
ment request and annexation, Mr. Haselwood has asked me to state what he
has said before. That is, under the appropriate circumstances, he would
be pleased to consider annexation of the West Hills area to the City of
Bremerton.
I trust that this information adequately addresses the Council's concerns~
If you have questions, I encourage you to call me and also suggest that you
visit the site. This matter is very important to us. We ask for your
favorable consideration on September 10, 1986.

EASEMENT fOR MUTUAL BENEfIT
JESSIE MAE RANDOLPH, a single woman, and HENRY HARRIS and LUCILLE R. HARRIS, husband
and wife, and the CITY Of BREMERTON, a municipal corporation, hereby grant and convey
each unto the other their successors and assigns an easement for ingress, egress and
utilities, on, over and across the following described land where each party warrants
that they are fee simple owners of their respective parcels, situated in the County of
Kitsap; State of Wasington, to-wit:
EASEMENT LOCATION
A strip of land sixty (60) feet in width, being thirty (30) feet on each side of a
centerline described as follows:
Beginning at the Southeast corner of the Northeast quarter section of
Section 21, Township 24 North, Range 1 East, W.M., thence North 88049'33"
West along the South line of said subdivision, 604.06 feet to the true
point of beginning of the aforementioned centerline; thence North 01051'19"
East 297-79 feet to a point of curvature nf a ~urve to th~ l~ft; thenc~
northerly along an arc of said curve, having a radius of 250.00 feet and a
central angle of 19043'01", for an arc distance of 86.03 feet to"a-point
of tangency; thence North 17051'42" West 98.46 feet to a point of
curvature of a curve to the right; thence northerly along an arc of
said curve, having a radius of 250 feet and a central angle of 17052'54"
for an arc distance of 78.02 feet to a point of tangency; thence North
00001'12" East 80.70 feet to the south margin of Werner Road and the
terminus.
TOGETHER WITH a strip of land sixty (60) feet in width, being thirty (30) feet on

79.34 feet to a point of tangency; thence North 70049'33" West 90.13
feet to the easterly right-of-way line of Union Avenue and the

THIS EASEMENT is beneficial and appertenant to those properties described in Exhibit A
