This Agreement, made and entered into this 22nd day
of January,' 1986, by and beb'leen the City of Bremerton ("City")
and Dr. Robert G. Addison ("Addison"), is as follows:
WHEREAS, Addison owns a parcel of viaterfront real
property in the City of Bremerton, including tidelands, described
ln Exhibit A attached herein; and
WHEREAS, the City of Bremerton is desirous of obtaining
an easement across this parcel of property in order to construct
and maintain a sewage connection; and
HHEREAS, Addison has agreed to this easement and has
executed a General Easement Agreement drafted by the City; and
WHEREAS, the City and Addison have agreed to supplemental
terms and conditions of this easement which are in addition to
those enumerated in the General Easement Agreement;
FOR AND IN CONSIDERATIO~T of the mutual covenants,
promises and benefits contained herein, the City and Addison agree
as follows:
1. The City shall return Addison's property to its
condition prior to the construction of the new sewer line and
will bear all expense involved thereto.
2. The City shall do whatever is necessary to prevent
future sewer backups on the Addison property and will be responsible
and liable for any and all damages incurred by any such future
sewage backups.
3. Nothing in this Agreement shall have the effect of
placing liability on the City for any sewer backup caused by that
portion of the sewer line from the Addison residence to the
connection with the City's sewer lines.
4. The City will cooperate with Addison in any
future remodeling or construction project on the subject property
that involves connection with the City sewer lines.
IN WITNESS llliEREOF, this Agreement has been duly executed
by the parties, hereto, to be effective on the day and year first
above written.
