RELEASE OF COVENANT AND LEASE TERMINA nON
WHEREAS, on December 3,-1986, the State of Washington, Department of General
Administration, acting for and on behalf of the Washington State Patrol, granted the City of Bremerton a
Warranty Deed to three parcels ofland located in Section 21, Township 24 North, Range I East,
Willamette Meridian, which deed is recorded under Kitsap Auditor's File No. 8704300283; and
WHEREAS, the Warranty Deed contained a covenant stating: "The City of Bremerton shall lease
that portion of said Parcel where the communications tower and support equipment is presently located to
the State of Washington in perpetuity"; and
WHEREAS, on April 8, 1987, the City of Bremerton and the Washington State Patrol acting
through the Department of General Administration entered into a Land Lease for a portion oftlie property
conveyed by Warranty Deed upon which the communications tower and support equipment was located.
That Land Lease is recorded under Kitsap Auditor's File No. 8704300285; and
WHEREAS, the Land Lease was modified on September 11, 1987 as set forth in the Lease
Modification recorded under Kitsap Auditor's File No. 8709280118; and
WHEREAS, the communications tower and support equipment has been removed from the site
and the Washington State Patrol has abandoned the premises as a communications site; and
WHEREAS, the City desires to sell said property;
NOW THEREFORE, the State of Washington, Department of General Administration, acting on
oehalf of the Washington State Patrol, hereby releases and quitclaims the covenant property described in
that Warranty Deed recorded under Kitsap Auditor's File No. 8704300283 from the requirement to lease in
perpetuity to the State of Washington that portion of said parcel where the communications tower and
support ~quipment was previously located.
FU R TH ER, the State of Washington, Department of General Administration, acting for the
Washington State Patrol and the City of Bremcrton hereby terminate that certain Land Lease recorded
under Auditor's File No. 8704300285 as amended under Kitsap Auditor's File N~. i<709280 I 18 and that
Land Lease is of no further force or effect.

11. In the event the leased premises are destroy~d or injured by
fire, earthquake or other casualty so aD to render the premises totally
unf i t for occupancy, and the Lessor neglects or refuses to
restore said premises to their former condition, then the Lessee may
terminate this Lease and shall be reim~ursed for any unearned tent that
has been paid. In the event said premises are partially d~stroyed by any
of the aforesaid ag~ncies, occurrenc.e of such de~truction or injury until
the premises are again restored to their former condition, ~nd any rent
paid by the Lessee during the period of abatement shall be credited upon
the next installment of rent to be paid.

12. It is understood that no guarantees, express, or implied,
representations, promises or statements have been made by the Lessee
unless endorsed hereon in writing. And it is further understood that
this lease shall not be valid and binding upon the State of Washington,
unless same has been approved by the nirector of the Department of
General Administration of the State of Washington and approved as to form
by the office of the Attorney General.
13. In the event the Lessee has requirements for alterations/
remodeling during the term of this lease, any renewals and/or
modifications thereof, the Lessor shall have the right to provide such
services. If the Lessee considers Lessor's alterations/remodeling costs
are excessive, the Lessee shall have the right, but not ~he obligation,
to request and receive at least two independent bids; and the Lessee
shall have the right at its option, to select one alternative ~ontractor
whom the Lessor shall employ and allow to provide such services for the
Lessee in c0mp1iance with the Lessor's building standards and operation
procedures.
