As a result of increased revenues and reduced expenditures, the General Fund had a higher ending fund balance than was anticipated to carry forward as the beginning fund balance for 2007. $18,000 of this balance carry forward is requested to provide a $2,000 funding 'boost' to nine public service agencies partially funded with CDBG funds in 2007. A breakdown of these agencies and the services provided is attached. She added that the additional funding would be used for Kitsap Sexual Assault Center for counseling of abused children; Kitsap Community Resources for staffing of transitional housing to prevent homelessness; RMH Services for counseling of mentally ill patients; YMCA for childcare scholarships; Bremerton Parks and Recreation Department for a lunch program at Matan and Evergreen Parks; Kitsap Boys and Girls Club to staff the new site at Naval Avenue Elementary School; Kitsap Literacy Council for helping individuals attain sufficiency and GED certifications; YWCA for a bilingual advocate; and Catholic Community Services to staff Benedict House. PUBLIC HEARINGS 7A - RESOLUTION NO. 3030 TO ADOPT THE 2008 CDBG CDBG/HOME POLICY PLAN (#AB07- 105): Marie Vila, Department of Community Development, stated that the CDBG/HOME Policy Plan sets parameters for the City's management of its HUD entitlement including outlining the citizen participation plan, application and review processes, and eligibility and implementation requirements for grant funded projects. She added that changes in the plan were 1) HOME funding be included with CDBG funding in the competitive selection for eligible projects 2) The City will prioritize the use of HOME funds to Designated Blight Zones, and may set aside HOME funds for future use, including a City initiated project 3) Sets a maximum subsidy of $30,000 per homeowner unit created with HOME funds 4) Requires a match ratio of 2:1 (two dollars from other sources to each HOME dollar) and 5) HOME applicants will have the option to request funds as a grant or as a loan. Larrv Ever, Kitsap Community Resources, commended Betsy Howe and Marie Vila as staff who he worked with during the funding process; and thanked the City for their past and possible future support. Mike Walton, Kitsap County Community Development Corporation looked forward to working with the City during future application cycles and hoped that the KCCDC will be a more qualified applicant in the future. Mr. GehrinQ asked for clarification on blight zones. Ms. Vila answered that the blight zones would include Anderson Cove and downtown at this time. Ms. Robinson added that this plan has been discussed in committee and was pleased that this program is available to the public. Mr. Maupin commended staff for working to improve this process. Mr. Wofford encouraged the public to contact the Mayor's office if interested in serving on the citizens' committee that addresses this issue. Mr. Brockus announced that the application due date for CDBG and HOME funding is Friday, July 20th at 5:00 PM. 06:31 :013 M/S/C/U (Wofford/Brockus) Move to approve the 2008 CDBG/HOME Policy Plan and pass Resolution No. 3030. City Council Reg. Mtg. Minutes Wednesday, May 2,2007 Page 4 of 6 6C - ORDINANCE NO. 5008 TO AMEND SECTION 17.04.040 "BUILDINGS AND CONSTRUCTION" AND SEVERAL MINOR AMENDMENTS TO TITLE 20 "ZONING CODE" OF THE BREMERTON MUNICIPAL CODE (#AB07-106): Nicole Ward, Department of Community Development, emphasized that the action before the City Council tonight is to conduct a public hearing and adopt Ordinance No. 5008 amending BMC Section 17.04.040 and several sections of the Zoning Code, BMC Title 20 including definitions, outright allowed uses for several zones, development standards for several zones, accessory dwelling unit requirements, fencing requirements, landscaping requirements, and sign standards. The Planning Commission and Community Development staff supports the passage of these amendments to the Zoning Code. Ida Mae Cooper expressed concerns over the increase in the size of the accessory dwelling units (ADU's) and asked if this will be allowed in single family residential neighborhoods. Helen Miller asked if the fencing requirements apply to new construction or apply to pre-existing homes. Don Larson encouraged the City to support low impact development when approving projects to maintain the character of neighborhoods and to minimize pollution. Patricia Hennessv was supportive of the proposed changes and believed that the changes would support a project she has planned for her neighborhood. Louie Clauson suggested that a 2400-square foot total for both home and accessory dwelling unit be considered. Scott McBride asked Council to support the changes so that people may build housing for aging parents. Jerrv Scott suggested that 1500-square feet be the limit that would allow people to construct projects that are both useful but not overwhelming to the neighborhood. Jim Fitzwater also suggested that the minimum square footage be increased to accommodate a project since the 1200 square footage would not be enough to protect and store property. 6:56:03 Main Motion was made as discussion continued... 6:56:58 Amending Motion was made as discussion continued... Mr. McConnell and Ms. Priest provided comments in opposition to the amendment. Ida Mae Cooper expressed concerns over the potential size of the ADU's. Mr. Maupin responded that the proposed change would not change the requirements for accessory dwelling units. Ms. Ward stated that the footprint of the structure is limited to 60% of the lot size and that the size of the structure would be reached sooner for smaller residences than for larger ones when the 60% is applied. Ms. Spencer added that the maximum would be up to 2000-square feet and could be divided among smaller structures or one large structure, based on the suggested amendment. Mr. GehrinQ emphasized that the larger square footage would allow someone with a larger lot the opportunity to store their items, and that the option is fair and should be considered. 07:10:32 A-M/S/F(Gehring/Robinson) Move to amend BMC Section 20.79.060 (b) (1) to modify the language to read "the maximum area for all accessory structures shall be eighty percent (80%) of the principal residential use not to exceed two-thousand (2000)-square feef'. City Council Reg. Mtg. Minutes Wednesday, May 2,2007 Page 5 of 6 Voted in favor of the motion: Robinson, Gehring, Brockus Voted against the motion: Priest, Wofford, McConnell, Maupin Motion failed: 3-Yes; 4-No Ms. Ward and Ms. Spencer addressed comments made previously by citizens... Ms. Ward responded that either the residence or the ADU must be owner occupied which means that the units will be better cared for and maintained; and the size of the structure will be smaller than the main residence. Ms. Spencer responded that there will be no further permitting for fences; and scale is addressed in the code changes by keeping the size of the ADU smaller than the residence. Mr. McConnell supported the changes relating the fences but did not support accessory dwelling units; and asked for more information on tree size standards. Ms. Ward clarified that tree size varies based on location such as landscaped areas and residential areas. Ms. Robinson asked for clarification on what defines a shop. Ms. Ward summarized that garages are for storage and shops are for projects. Mrs. Priest did not believe that having ADU's goes against the goal of home ownership since the owner resides in one of the structures. Mr. McConnell asked for clarification on development coverage and lot coverage. Ms. Ward stated that development coverage and lot coverage are essentially the same, but in the code the language is used interchangeably. Mr. Wofford hoped that the Planning Commission consider a larger ADU and then bring that proposal back to Council. Mr. GehrinQ added that owners have a vested interest in protecting their property and providing affordable housing. Mr. Maupin believed that the problem with rentals in the City is that the rentals are operated by absentee landlords; and believed that having ADU's would improve home ownership and alleviate bad renter situations. Mrs. Priest asked for clarification on density calculation. Ms. Ward stated that the language allows staff to use lot boundaries instead of tax boundaries to determine true density in a given neighborhood. 07:27:56 M/S/C/U (Wofford/Brockus) Move to pass Ordinance No. 5008 to amend BMC Section 17.04.040 Buildings and Construction and several sections of the Zoning Code, BMC Title 20.
