CITY OF TUMWATER
COOPERATWE PURCHASING AGREEMENT
In accordance with RCW Chapter 39.34 and applicable provisions of city ordinance, the City of
Tumwater and The City of Bremerton hereby agree to a cooperative governmental purchasing
agreement for the purpose of purchasing various supplies, materials, and equipment, using the
Cities' competitively awarded contracts. The following terms and conditions apply:
1. Each City, in contracting for the purchase of supplies, materials, and equipment,
agrees, at its sole discretion, to extend said contracts to the other City to the extent
permitted by law, and agreed upon by the parties and the vendor(s).
2. Each City shall be responsible for compliance with any additional or varying laws
and regulations governing purchases by or on their own behalf, including, but not
limited to, compliance with the applicable provisions of RCW Title 39.
3. Any purchases shall be implemented by purchase order and directed to the vendor.
The purchase order shall specify that the item(s) ordered are to be delivered to the
City that placed the order.
4. Neither City shall accept responsibility for the performance of any vendor contracted
for by the other City as a result of this Agreement.
5. Neither City shall be responsible for the payment of any item(s) contracted for by the
other City as a result of this Agreement.
6. Each item purchased shall become the sole property of the City that placed the order.
The other City shall have no right or interest in or claim of title to that property.
7. This Agreement shall commence August 1, 2003, and end July 31, 2004, unless
canceled in writing by either party with 30 days advance notice to the other party.
8. Whenever, under this Agreement, notice is required to be given to the other party,
said notice shall be sent as follows: City of Tumwater, Attention: Finance Director,
555 Israel Road SW, Tumwater, WA 98501; City of Bremerton, Attention: Bill Eley,
239 4th Street, Bremerton, WA 98337.
9. The Administrator for this Agreement is the Finance Director for the City of
Tumwater.
10. For all purchase orders submitted by the City of Tumwater, the applicable provisions
of TMC 2.14 and 3.46 will apply and any other applicable provisions of the
Tumwater Municipal Code not otherwise mentioned.
