THE NAVAL CRIMINAL INVESTIGATIVE SERVICE
1. This Memorandum of Understanding (MOU) is intended to create a
collaborative effort and partnership between the Naval Criminal
Investigative Service (NCIS) and the City of Bremerton Police
Department and its Special Operations Group (SOG) to enhance joint
investigative abilities in order to more effectively identify,
arrest and deter those members, civilian and military, of our
community involved in the use, sale, manufacturing and distribution
of narcotics.
2. An NCIS agent will be assigned to the SOG to provide support and
assistance on narcotics operations and investigations which includes
narcotic buys, surveillance, service of warrants and arrests of
suspects.
3. During his tenure with SOG, the assigned NCIS agent will attend
mandatory training, provide support and conduct investigations for
SOG generated cases related to the Department of the Navy and/or
Department of Defense. The City of Bremerton Police Department
recognizes that the assigned NCIS agent has reporting
responsibilities to NCIS regarding his assigned duties at SOG.
Prior to reporting information to NCIS regarding an ongoing SOG
investigation or covert operation, the assigned NCIS agent will
inform his SOG supervisor what intelligence and case information is
being disclosed to NCIS superiors, so that NCIS and SOG superiors
can ensure the investigation and operation is not compromised.
4. The City of Bremerton Police Department will issue a limited police
con~ission to the NCIS agent assigned to work with the City of
Bremerton Police Department's SOG. This limited commission is
authorized when assigned to SOG and gives authority to the NCIS
agent to enforce ordinances of the City of Bremerton, State and
Federal Law, and to protect the public peace and safety within the
City of Bremerton. This commission is valid during work hours and
for a period of one year and shall automatically expire on December
31st of each year. At the conclusion of this partnership all forms
of identification and authorization issued by the City of Bremerton
Police Department will be returned and terminated.
5. The City of Bremerton Police Department will issue to the assigned
NCIS agent for duty use, a portable radio with necessary frequencies
to properly communicate with SOG members. Normal repair will be the
responsibility of the City.
6. NCIS agrees to furnish and pay for service of a cellular system for
its assigned agent that is compatible to cellular equipment utilized
by SOG.
7. City of Bremerton Police Department will provide workspace and work
station with required computer equipment and maintenance support for
the NCIS assigned agent.
8. For operational necessity, the assigned NCIS agent will be
authorized to participate in SOG required training and meetings that
will enhance knowledge of narcotic investigations and intelligence
gathering.
9. When working SOG cases, the assigned NCIS agent's work hours will be
determined by the SOG supervisor and the assigned agent will work
under the supervision of the SOG supervisor.
10. This partnership can be dissolved at any time by either party with
the understanding that all reasonable attempts will be made not to
jeopardize active undercover operations and personnel.
