MEMORaNDUM OF UNDERSTANDING
Gorst Area Wastewater Study
THIS IS AN AGREEMENT between Kitsap County, City of Bremerton, city of
Port Orchard, Sewer District #5, and Port of Bremerton pursuant to the
Interlocal Cooperation Act, Chapter 39.34 RCW ( collectively referred to
as "The Partners" in this document).
Whereas, Chapter 39.34 RCW permits local government units to make
the most efficient use of their powers by enabling them to cooperate
with other localities to provide services in more efficient manner, and;
Whereas, the Gorst area of Kitsap County has been declared a severe
public health hazard by the Bremerton-Kitsap County Health District due
to failing on-site sewer systems; and
Whereas, the soils in the Gorst area are not suitable for disposal
of sewage effluent; and
Whereas, the costs of repair and or replacement of existing on-site
systems will be prohibitive to individual landowners of the Gorst area;
and
Whereas, the repairs and improvements completed on individual
systems in the past 10 years have failed to make any significant
improvement in the overall water quality, or to reduce the public health
hazard of the Gorst area; and
Whereas, untreated effluent continues to infiltrate into
groundwater and Gorst Creek being transported to Sinclair Inlet where it
impacts the water quality and modifies the shellfish and wildlife
habitat; and
Whereas, alternate technology which is currently available only
corrects a portion of the problems facing owners of currently failing
systems; and
Whereas, the Gorst Community and surrounding beach properties and
industrial area desire to manage the growth, which is expected to occur,
by assuring full compliance with health standards while preserving and
enhancing the natural habitat of the area; and
Whereas, Kitsap County's current Planning Commission Recommended
Comprehensive Land Use Plan commits the County to encourage and support
Job Diversification and Economic Development; and
Whereas, the City of Bremerton~s wastewater plant and the City of
Port Orchard/Sewer District 5 wastewater plant are the only existing
treatment facilities near the service area; and
Whereas, it is in the best interest of all of the citizens of the
County and Cities to protect the health of their constituents, improve
and protect the quality of the local water environment, and provide job
opportunities for their constituents; and
Whereas, the Port of Bremerton, the Olympic View Landfill, the
owners of Industrial Land in the South Kitsap Industrial Area, Northwest
Corporate Campus, and the owners of land in the Gorst area are
interested in exploring the feasibility of providing sewer service to
their respective lands, hereinafter referred to as the "service area,"
Exhibit "A"; and
Whereas, The Partners are in general agreement that sewering of
Gorst and the Industrial Lands should be explored together and
considered with a view to the long term strategic plan for dealing with
wastewater regionally in South Kitsap County, and potentially, Hood
Canal and portions of Hood Canal; and
Whereas, The Partners, and private property owners in the service
area have indicated that they are willing to share the financial
responsibility for conducting a feasibility study to provide sewer
service to the Gorst Area and the South Kitsap Industrial Urban Growth
Area; and
Whereas, The Partners share of financial responsibility shall be
reimbursed or credited to their respective accounts without interest or
CPI indexing and with formation of the "local improvement district"
(LID) for implementation of the study recommendations, provided the LID
is formed within six (6) years of the expenditure; and
Whereas, The Partners have indicated a willingness to participate
in the consultant selection process, in the provision of data,
information and access to facilities, and to participate in the review
and workshop sessions required to complete the study;
NOW, THEREFORE, it is agreed between the Partners as follows:
1. The Partners shall authorize Kitsap County to proceed with
the selection of a consultant to conduct a study of the

their areas of responsibilities to the'selected consultant in
a timely manner.
5. The Partners agree to attend the coordination and workshop
sessions.
6. The Partners agree to consult with their respective governing
bodies about this project as it progresses, and to facilitate

Draft Scope of Work
Study of the Wastewater Colketion and Treatment Alternatives
For The South Kitsap County Indmtriai Urban Growth Area
and The Gorst Area
Kitsap County, City of Brcmcnon, City of Port Orchard/Sewer District #5, Port Of Bremerton,
Olympic View Landfill, and owners of the Industrial Urban C-torah Area land in South YAtsap
County, wish tO exsmine the alternative, reasonable, feasible wastewatcr conveyance route~, and
associated conveyance facilitiea required to convey wastewaler from the South Kitsap Industrial
Urban Grovah Area, and the Goret Urban Grovah Area, to the City of Bremerton's Wa.stewatcr
Trea~nent Plant, and/or the City of Port Orchard/Sewer Dishict 5 Wastewal~r TreaUnent Plant.
Gorst has been designated a severe health ha~?d area by thc Brcmerton-Kitsap County Board of
Health. This is due to failing on-site systems and inadequate soil conditions in the area for on-site
systems. Thc Port's property located in the South K/t3ap County Industrial Growth Area has an
existing domestic wastewater h'eatmcnt facility that discharges to land application. The Olympic
View Landfill has l~achete ~ceaWflant that is hauled for disposal. Industrial wastes are forbidden and,
therefore, the type of clientele the Port can serve is limited. The Northwest Corporate Campus also
requires sewer service to be econom/cally viable.
All of the participants listed above desire to solve the health hazard problems at Gorst, e-h~-ce the
water quality conditions in Sinclair Inlet and encourage indu.~ial development in thc Industrial
Urban Growth Area, Thes~ parkers have agree~ to share the costs of this study of this study of
altemaliv~ and to participate in supporiing the work of thc study. The County has elp~xl to be the
lmui agency and to be the facilitator for the report preparation. This effort is intended to lead direcily
to implementation of the recommendations.
The Partners are concerned that the recommended altemativc be compatible w/th thc future
development of wastcwater facilities in the south County area. Therefore, it will be required that the
report address the compatibility of thc recommended alternative with thc County's DraR
Comprehensive Wastewater Management Plan of April 1995. Thc City ofBremerton'a Waztcwater
Comprehensive Plan and the City of Port Orchard/Sewer Dis~ict #5's Comprehensive Plan.
Amendments to any of these plans may be necessary dependent on thc finds of this study.

defined service and beoefited areas over the next 20 and 50 year hodzom, including
peak wet weather month, and peak hourly flows. Provide. basis for estimates
iuclud/ng the BOD$, solids and any other pollutants of significance.
Task IV. Define reasonable, feasible routes for the transfer of wastewatcr from the setwice
area~ (maps attached) to the two/reatment plants. Base figs on the best topographic
informsfion available. Identif'y all componenLs of each system, its locat/on, capacity
and co~t. Display these alternatives on main with tabular lx:preselltafion of
componcnt capacity and cost. Include mitigation for odor, noise, and aesthetics.
Pro. vide basis for cost estimates and level of confidence. Incorporate operating and
mamtenancc costs for each altemativc.
.Task V. Prepare and present information gcneratcd in Tasks I through IV to Coordinating
Committee for discussion and decision making workshop. The product of this
workshop will be a recommended plan. Consultant will facilitate the workshop.
