SUMMARY: Roberto Victoria owns the property located at 102 and 108 Oyster Bay A venue, which
is adjacent to the Oyster Bay Complex. The home at 102 Oyster Bay A venue was destroyed by fire in
September. Staff proposes purchasing the property for expansion of the Public Works and Utilities
facility. A commercial realtor was asked to provide an estimate of value for the property if the
structures were removed. That estimate is attached. The owner has agreed to sell these parcels to the
City for the estimated value of$140,000.

FISCAL IMP ACTS (Include Budgeted Amount): The total purchase price for the property is
$140,000. The funds to purchase the property will come from the ending balance in the Water Fund.
The final balance of the Water Fund will be above the targeted level indicated in the Financial Policy.
A budget adjustment is required.

RECOMMENDED MOTION:
Move to approve the Real Estate Purchase and Sale Agreement with Roberto Victoria and authorize
the Mayor to finalize and execute the agreement with substantially the same terms and conditions as
presented and further authorize the Mayor to finalize and execute any and all documents necessary to
close the transaction, and adjust the 2006 Budget to reflect the property purchase.
