RESOLUTION NO.____
A RESOLUTION of the City Council of the City of
Bremerton, Washington, declaring certain property, consisting of
approximately 333 square feet, surplus to the City's needs and
approving a conveyance of the property in accordance with the
provisions ofBMC 2.78.010.
WHEREAS, the City acquired a portion of 151 Street right of way when the
roadway was vacated in 2000 for construction of the Bremerton Transportation Center (BTC)
consisting of approximately 333 square feet, more particularly described in Exhibit A; and
WHEREAS, the City has expended no monies to receive the parcel; and the BTC
has had continuous use of the property since being conveyed to the City; and
WHEREAS, the City has no current or future plans for the property; and
WHEREAS, BMC 2.78.010(c) provides that if the real property has value only to
an abutting owner of land, the City shall notify the abutting owner that the property is for sale
and allow them an opportunity to submit an offer to purchase the property and/or match any offer
presented; and
WHEREAS, the abutting property owner is the Washington State Department of
Transportation (WSDOT) and they have expressed a desire to incorporate the property into the
BTC Site Sundry Plan; and
WHEREAS, the City Council has determined that this property is not utility
property and is surplus to the City's needs; and
WHEREAS, the property has no inherent value to the City; NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF BREMERTON, WASHINGTON,
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The property legally described in Exhibit A is hereby declared
surplus to the City's needs and approved for transfer to WSDOT pursuant to BMC 2.78.010.
SECTION 2. The property shall be transferred by Quit Claim Deed, with no
compensation due for the property transfer.
SECTION 3. The Mayor is hereby authorized to finalize and execute any and all
documents, including but not limited to quit claim deeds and real estate excise tax affidavits,
necessary to complete the transaction.

SECTION 4. Severability. If anyone or more sections, subsections, or
sentences ofthis Resolution are held to be unconstitutional or invalid, such decision shall not
affect the validity of the remaining portion of this Resolution and the same shall remain in full
force and effect.
SECTION 5. Effective Date. This Resolution shall take effect and be in force
immediately upon its passage.

LEGAL DESCRIPTION
Those portions of 1 sl Street (formerly Front Street) of the Plat of the Town of Bremerton,
as recorded in Volume 2 of the book of plats, Page 30, records of Kitsap County,
Washington, situate in Government Lot 1, Section 24, T. 24 N., R. 1 E., Willamette
Meridian, Kitsap County, Washington, lying east ofthe easterly right of way for
Washington Avenue, and southerly of a line more particularly described as follows:
Beginning at the centerline intersection of Pacific Avenue and said 1 sl Street; thence east
along the centerline of said 1 sl Street S 88024'32" E 329.63 feet to the centerline
intersection with Washington Avenue and the True Point of Beginning; thence leaving
said centerline, S 88024'32" E 26.37 feet; thence S 13034'15" E 18.74 feet to the
intersection with the easterly right of way of said W ashington Avenue; thence continuing
S 13034'15" E 10.43 feet; thence on a curve to the left, the center of which bears N
76025'45" E 157.00 feet, through an angle of 14038' 18", an arc length of 40.11 feet;
thence S 28012'33" E 41.84 feet; thence S 29013'24" E 106.47 feet; thence S
29012'05"E 50.69 feet; thence S 45049'54" E 115.55 feet to the Inner Harbor Line and
the Terminus.
