It was also noted that an amendment was made to Item (3)ounder Section 9, "Permitted Uses" to clarify language. Karen VarQas referred to Section 20.60.020 "Permitted Uses", and asked how the amendment to the language of item (c) would affect her existing day care facility. Chris HUQo, Director of Community Development responded that the "Special Use Permit" this business was previously granted is still durable, and is not affected by these proposed zoning changes. Richard Eric Niemeth asked if any of the proposed changes to the Zoning Code would affect non-conforming use structures in an R-10 Zone. Mr. HUQO stated that he was aware of the project referred to by Mr. Niemeth, and that there were no proposed changes to the Zoning Code that would affect this situation. President McConnell closed the Public Hearing. 06:03:32 M/S/C/U (Priest/Shepherd) Move to pass Ordinance No. 4977 to amend several sections of the Zoning Code, BMC Title 20, as amended. 6B - ORDINANCE NO. 4978, VACATING VARIOUS STREETS AND ALLEYS LYING SOUTH OF BURWELL STREET, WEST OF PACIFIC AVENUE, AND SOUTH OF 1ST STREET IN DOWNTOWN BREMERTON (#AB06-188): Gary Sexton, stated that the City, in a collaborative effort with the U.S. Navy, initiated the vacation of various streets and alleys lying south of Burwell Street, west of Pacific Avenue, and south of 1 sl Street in downtown Bremerton in the continued revitalization of the downtown corridor. Minutes Wednesday, September 6, 2006 Page 3 of 4 7A - RESOLUTION NO. 3007 APPROVING THE 2007 TO 2012 SIX-YEAR TRANSPORTATION IMPROVEMENT PLAN (#AB06-189): Phil Williams, Director of Public Works, summarized highlights of the Six-Year Transportation Improvement Plan (TIP) that was prepared pursuant to RCW 35.77.010 and is required to apply for Federal Funding. The Plan is updated annually and filed with the Secretary of Transportation, Local Programs Office. It is intended as a planning tool for local, State, and Federal transportation funding entities. The attached plan has been prepared for City Council approval by Resolution No. 3007, and will be submitted to the Washington State Department of Transportation. There were no comments from the public. Mr. Shepherd stated that he would not support the proposed plan because mass transit solutions were lacking for the Wheaton Way corridor, particularly expressing his concerns with the project designated for improving the intersection of Warren Avenue & 11th Street. Mrs. Arends stated that it was her understanding that the Warren Avenue & 11 th Street project was a State project. Mr. Williams clarified that the Warren Avenue & 11th Street project was a "City Project" on a "State Highway" so both entities would be involved to address both vehicular and pedestrian safety issues. Mr. Brockus asked why the Manette Bridge Replacement Project was not included. Mr. Williams explained that this entire project was a State Project because the City was not providing any of the funding. Ms. Priest commented that she would like to see future street projects in-line with the priorities of the City's Comprehensive Plan. 06:29:55 M/S/C (Priest/Arends) Move to approve Resolution No. 3007, which approves the City's 2007 to 2012 Six-Year Transportation Improvement Plan, and direct the Mayor to forward the Resolution and Plan to the Department of Transportation, Local Programs Office. He pointed out that this resolution accepts the initial petition by owners of not less than 10% of assessed property value in the proposed area to annex territory into the City; and further requires the adoption of the City's Comprehensive Plan land use designation for the proposed annexation area; and requires the assumption of the City's existing indebtedness by the area to be annexed. Irene Bach submitted a copy of a petition signed by neighbors who agreed with her concerns regarding this proposed annexation; and Ravmond Hansen and John Tietien and provided additional testimony to voice their concerns due to the many unanswered questions. Richard Eric Niemeth asked questions about the sale of the Tracy ton Watershed Property to a developer, and was there an allowance for this annexation. Mr. Williams addressed details of the purchase and sale agreement with a developer for the 40- acre Tracy ton watershed parcel, which is intended to be developed with approximately 100 homes contingent upon the property being annexed into the City. He also stated that Waste Management would be the provider for trash pick up whether a home in the area is a "County" or "City" resident. City Council Reg. Mtg. Minutes Wednesday, September 6,2006 Page 4 of 4 Mr. HUQO addressed additional concerns raised during the testimony of residents from the proposed annexation area. As we review the financial results through the second quarter of 2006 and begin the process of developing the proposed 2007 budget, it is a good time to project and revise the revenue and expenditure expectations for the remainder of the year. Enclosed is a proposed mid-year budget amendment ordinance and supporting schedules. There are sufficient funds to cover the proposed additional expenditures from the respective fund balances. The General Fund, Water, Wastewater, and Stormwater Utilities, and Gold Mountain Golf Fund all meet the ending fund balance requirements of the City's adopted Financial Goals & Policies after implementation of the proposed budget adjustments. There are a variety of issues addressed in the amendments. Some of the more significant items include: . Incorporation of actual beginning fund balances . Formally adopt and incorporate previous 2006 budget changes approved by council action . Adjust the fuel budget for the ERR Fund due to substantially higher fuel prices and adjust the service charges to various City departments for those additional fuel costs. This results in increased budget appropriations for the ERR Fund and the funds using these services and an increase in the revenues of the ERR Fund. The citywide increase proposed is $70,000 - of which $34,405 is attributable to the General Fund. . Increase Unemployment Compensation Expense in the General Fund Miscellaneous Non-Departmental Budget by $55,000 to cover additional expenses incurred in 2006 above the original budget expectations 2006 Mid-Year Budget Amendment Page 1 of 4 . Increase revenues and expenditures in the General Fund (B&O tax revenues and outside services) by $100,000 to allow payment to Tax Recovery Services for B&O tax audits that have yielded payments of back taxes for the City. . Increase supplies & services budget of the Engineering Department in the General Fund by $50,000 to begin development of a non-motorized transportation plan. This was originally requested in the 2006 budget but was removed during the Mayor and Department Head review process in order to balance the budget. With the General Fund's positive fund balance carry forward from 2005, this work is now being requested to be added back to the 2006 budget. . Increase the General Fund transfer to the Bond Fund by $56,000 to cover a deficiency in the property tax levy for the 1997 UTGO Fire Refunding Bonds. The Assessor's Office failed to include the City's levy for this debt service obligation in the total levy amount made in 2005. We have received a written confirmation of this oversightJrom the Assessors office and the funds will be replenished in 2007 with the correction to the levy assessment, however in the meantime the Bond Fund does not have sufficient funds to cover the deficiency and a budget adjustment transferring additional money is required. . Increase the supplies and services budget for the General Fund's Miscellaneous Non-Departmental fund by $9,300 to_allow the City's participation in a regional study of Economic Development options coordinated by KRCC. . Adjust the budget to transfer $100,000 from the General Fund to the Conference Center Operating Fund for and reduce the previously anticipated transfer from the Contingency Reserve by this same amount. The budget contemplated $300,000 of funds would be provided from sales of City assets for the purpose of retiring early a portion of the outstanding variable rate Line of Credit debt for the Conference Center. Some of the properties anticipated to be sold to provide these funds have been determined to not be available for sale. It is still expected that $200,000 will be available from asset sales for early debt retirement, and this adjustment allows the full $300,000 of debt retirement to be accomplished by using a portion of the General Fund's positive fund balance carry forward from 2005 to achieve that objective. 2006 Mid-Year Budget Amendment Page 2 of 4 . Increase the supplies & services ($82,500) and capital expenditures ($60,000) of the Street Fund to cover higher supply and asphalt costs recently experienced by this Fund and to add back signal cabinet replacements which were originally requested in the 2006 budget but were removed during the Mayor and Department Head review process in order to balance the budget. With the Street Fund's positive fund balance carry forward from 2005, this work is now being requested to be added back to the 2006 budget. . Increase the Lodging Tax Revenue anticipated by $30,000 for the Civic Improvement Fund - reflecting revised expectations based on results through mid year 2006. . Adjust the Parking System revenues and expenditures to reflect deferment of the Pay & Display Meters implementation, as well as cost sharing reimbursements by Kitsap Transit and Anthony's Restaurant for conference center garage operating expenses. The net of these items is a positive adjustment of $44,250 to the fund. In addition, an additional $115,000 transfer to the Bond Fund is required from this fund to cover the projected additional expense in 2006 for rising i(lterest expense on the parking garage variable rate debt. There are sufficient funds to cover the additional expenditures from fund balance. The Bond Fund expenditures are also increased by $115,000 to reflect this additional interest expense. . Adjustment to the Community Development Block Grant Fund revenues and expenditures to correct the omission in the 2006 budget of CDBG allocations and projects that carried forward from prior years. . Adjustment to the Public Access Television (BKAT) Fund revenues and expenditures to reflect revised expectations on timing of PEG funds from the County (a lump sum payment will be received in 2006) resulting in a revised expectation of not proceeding forward with a debt issuance and other adjustments to reflect finalized service contracts with the City's of Port Orchard, Poulsbo, and Kitsap County. . The Harborside Park capital fund requires adjustments in revenues and expenditures to reflect funding sources and work that rolled forward from 2005 into 2006 and an increase in the transfer from this fund to the One Percent for the Arts Fund resulting from the increased expenditures anticipated to occur in 2006. . Increase the anticipated receipts of Real Estate Excise Taxes (REET) in the General Government Capital Improvement Fund by $200,000 based on actuals received through mid-year 2006. In addition, the capital expenditures in this fund are increased by $28,000 to cover costs of the Martin Luther King Library renovation that rolled forward from 2005 into 2006. 2006 Mid-Year Budget Amendment Page 3 of 4 . Increase the Police and Fire Pension Fund expenditures by $100,000 to cover increased retiree costs anticipated. There are sufficient funds to cover the additional expenditures in 2006. . Other miscellaneous adjustments and accounting expense/revenue category reclassifications as indicated in the attached supporting schedules. I have reviewed these adjustments with the Mayor and Fiscal & Budget Committee on August 2, 2006. The proposed adjustments are scheduled to be reviewed by the full City Council on August 23rd, with action anticipated on September 6,2006. Financial Services staff noted that the Bond Fund was coming up short on property tax receipts in 2005 and after researching the matter found that the County Assessor's Office failed to include this in the total levy assessments made in 2005. It appears it was overlooked because it was on the second page of the two page ordinance copy. The Assessors Office has provided a written letter acknowledging the omission and have indicated it will be corrected with the , 2007 property tax levy and that the City will need to formally "relevy" the assessment to accomplish the correction. In the , meantime, the Bond Fund does not have sufficient fund availability to cover this deficiency and a budget adjusment and transfer of $56,000 is needed in 2006. Financial Services staff noted that the Bond Fund was coming up short on property tax receipts in 2005 and after researching the matter found that the County Assessor's Office failed to include this in the total levy assessments made in 2005. It appears it was overlooked because it was on the second page of the two page ordinance copy. The Assessors Office has provided a written letter acknowledging the omission and have indicated it will be corrected with the 2007 property tax levy and that the City will need to formally "relevy" the assessment to accomplish the correction, In the meantime, the Bond Fund does not have sufficient fund availability to cover this deficiency and a budget adjusment and transfer of $56,000 is needed in 2006, The funds will be replenished in 2007 with the correction to the levy assessment FUND 201 CITY OF BREMERTON 2006 ANTICIPATED REVENUES, EXPENDITURES AND CHANGES IN FUND BALANCE LID GUARANTY FUND For the Year Ended December 31,2006 Proposed Adj Required Original Revised From The Budget Actuals Thru Budget Original Budget 2006 June 30, 2006 2006 2006 REVENUES Taxes Property $ $ $ $ Sales Other Licenses and Permits Intergovernmental Charges for Services Fines and Forfeitures Miscellaneous 14,800 5,007 14,800 Transfers in Total Revenues 14,800 5,007 14,800 EXPENDITURES Personnel Expenses Supplies, Services, and Taxes Capital Expenditures Debt Service Transfers Out 61,944 61,944 Total Expenditures 61,944 61,944 CHANGES IN FUND BALANCE Net change in fund balances (47,144) 5,007 (47,144) Fund Balances-beginning 47,144 47,144 47,144 Fund Balances-ending . $ $ 52,151 $ $ No Budget Adjustment Required FUND 202 CITY OF BREMERTON 2006 ANTICIPATED REVENUES, EXPENDITURES AND CHANGES IN FUND BALANCE CONFERENCE CENTER CAP IT AL PROJECT FUND For the Year Ended December 31, 2006 Proposed Adj Required Original Revised From The Budget Actuals Thru Budget Original Budget 2006 June 30, 2006 2006 2006 REVENUES Taxes Property $ $ $ $ Sales Other Licenses and Permits Intergovernmental Charges for Services Fines and Forfeitures Miscellaneous 40,738 41,556 41,556 Transfers in Total Revenues 40,738 41,556 41,556 EXPENDITURES Personnel Expenses Supplies, Services, and Taxes Capital Expenditures 21,869 45,869 45,869 Debt Service Transfers Out 11,000 11,000 Total Expenditures 21,869 56,869 56,869 CHANGES IN FUND BALANCE.
