6A - ORDINANCE NO. 4977 AMENDING SEVERAL SECTIONS OF THE ZONING CODE, TITLE
20 OF THE BREMERTON MUNICIPAL CODE (#AB06-187): Nicole Ward, Department of
Community Development, explained that the action before the Council is to conduct a public
hearing and adopt Ordinance No. 4977 amending several sections of the Zoning Code, BMC Title
20. It was also noted that an amendment was made to Item (3) under Section 9, "Permitted Uses"
to clarify language.
Karen VarQas referred to Section 20.60.020 "Permitted Uses", and asked how the amendment to
the language of item (c) would affect her existing day care facility. Chris HUQo, Director of
Community Development responded that the "Special Use Permit" this business was previously
granted is still durable, and is not affected by these proposed zoning changes.
Richard Eric Niemeth asked if any of the proposed changes to the Zoning Code would affect
non-conforming use structures in an R-10 Zone. Mr. HUQO stated that he was aware of the project
referred to by Mr. Niemeth, and that there were no proposed changes to the Zoning Code that
would affect this situation.
President McConnell closed the Public Hearing.
06:03:32 M/S/C/U (Priest/Shepherd) Move to pass Ordinance No. 4977 to amend several sections
of the Zoning Code, BMC Title 20, as amended.

owners. This is a Class II right-of-way and compensation has been waived in accordance with

7A- RESOLUTION NO. 3007 APPROVING THE 2007 TO 2012 SIX-YEAR TRANSPORTATION
IMPROVEMENT PLAN (#AB06-189): Phil Williams, Director of Public Works, summarized
highlights of the Six-Year Transportation Improvement Plan (TIP) that was prepared pursuant to
RCW 35.77.010 and is required to apply for Federal Funding. The Plan is updated annually and
filed with the Secretary of Transportation, Local Programs Office. It is intended as a planning tool
for local, State, and Federal transportation funding entities. The attached plan has been prepared
for City Council approval by Resolution No. 3007, and will be submitted to the Washington State
Department of Transportation.
There were no comments from the public.
Mr. Shepherd stated that he would not support the proposed plan because mass transit solutions
were lacking for the Wheaton Way corridor, particularly expressing his concerns with the project
designated for improving the intersection of Warren Avenue & 11th Street. Mrs. Arends stated
that it was her understanding that the Warren Avenue & 11th Street project was a State project.
Mr. Williams clarified that the Warren Avenue & 11th Street project was a "City Project" on a
"State Highway" so both entities would be involved to address both vehicular and pedestrian safety
issues.
Mr. Brockus asked why the Manette Bridge Replacement Project was not included. Mr. Williams
explained that this entire project was a State Project because the City was not providing any of the
funding.
Ms. Priest commented that she would like to see future street projects in-line with the priorities of
the City's Comprehensive Plan.
06:29:55 M/S/C (Priest/Arends) Move to approve Resolution No. 3007, which approves the City's
2007 to 2012 Six-Year Transportation Improvement Plan, and direct the Mayor to forward the

7B - RESOLUTION NO. 3008 APPROVING THE ANNEXATION PROCEEDINGS FOR
TERRITORY IN THE TRACYTON AREA OF EAST BREMERTON (#AB06-190): Chris HUQo,
Director of Community Development, was excited to present this annexation proposal. He pointed
out that this resolution accepts the initial petition by owners of not less than 10% of assessed
property value in the proposed area to annex territory into the City; and further requires the
adoption of the City's Comprehensive Plan land use designation for the proposed annexation area;
and requires the assumption of the City's existing indebtedness by the area to be annexed.
Irene Bach submitted a copy of a petition signed by neighbors who agreed with her concerns
regarding this proposed annexation; and Ravmond Hansen and John Tietien and provided
additional testimony to voice their concerns due to the many unanswered questions.
Richard Eric Niemeth asked questions about the sale of the Tracy ton Watershed Property to a
developer, and was there an allowance for this annexation.
Mr. Williams addressed details of the purchase and safe agreement with a developer for the 40-
acre Tracy ton watershed parcel, which is intended to be developed with approximately 100 homes
contingent upon the property being annexed into the City. He also stated that Waste Management
would be the provider for trash pick up whether a home in the area is a "County" or "City" resident.
