RESOLUTION NO. 3 00 (P
A RESOLUTION of the City Council of the City of
Bremerton, Washington, declaring certain property surplus to the
City's needs and approving a sale of the property in accordance
with the provisions ofBMC 2.78.010.
WHEREAS, the State of Washington has requested that the City convey certain
real property as right of way and grant a temporary construction easement for construction of the
BTC Ingress/Egress hnprovement Project; and
WHEREAS, the City has no current or future need or plans for use of the
requested property; and
WHEREAS, BMC 2.78.01O(b) authorizes the City to dispose of real property
using any appropriate means; and
WHEREAS, the City Council has determined that this property is not utility
property and is surplus to the City's needs; and
WHEREAS, the property has no beneficial public use at this time; and
WHEREAS, the City will receive as compensation for the real property and
granting of the temporary construction easement a minimum amount of $248,400; NOW
THEREFORE,
THE CITY COUNCIL OF THE CITY OF BREMERTON, WASHINGTON,
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The property legally described in Exhibit A and Exhibit B is
hereby declared surplus to the City's needs and approved for sale to the State of Washington
pursuant to BMC 2.78.010 in an amount not less than $248,400.
SECTION 2. The City is authorized to grant a temporary construction easement
to the State of Washington across the property legally described in Exhibit C.
SECTION 3. The Mayor is authorized to execute any and all documents,
including but not limited to quit claim deeds, the temporary construction easement, real estate
excise tax affidavits, and any and all other documents necessary to complete the transaction.
SECTION 4. Severability. If anyone or more sections, subsections, or
sentences ofthis Resolution are held to be unconstitutional or invalid, such decision shall not
affect the validity of the remaining portion of this Resolution and the same shall remain in full
force and effect.

SECTION 5. Effective Date. This Resolution shall take effect and be in force
immediately upon its passage.

19.41 feet; thence North 82052'37" East 81.69 feet; thence on a curve to the
right with a radial bearing of South 7007'22" East and a radius of 305.00 feet an
arc length of 168.53 feet; thence South 67003'41" East 33.99 feet; thence along a
curve to the left with a radial bearing of North 22048'27" East and a radius of
215.86 feet an arc distance of 34.74 feet to a point on said North margin lying
241.53 feet West of the Southeast comer of Block 14, of Town of Bremerton, as
