Helen Miller discussed a meeting that she and Representative-candidate Trent England had with the Mayor this morning to find out if the proposed tax advantage would apply to the luxury waterfront condominiums currently being built by Kitsap County Consolidated Housing Authority (KCCHA). City Council Reg. Mtg. Minutes VVednesday,August2,2006 Page 2 of 4 6A - CONTRACT PROVISION FOR WIRELESS INTERNET SERVICE IN THE DOWNTOWN AREA WITH WAVE BROADBAND (#AB06-164): Bill Eley. Information Technology Manager, explained that the Information Technology Division has solicited proposals to provide a free public wireless internet service for the downtown area, so as to provide an additional economic boost to that area. VVAVE BROADBAND provided the lowest cost, responsive proposal. The cost to provide the infrastructure is $48,250 and it is anticipated that there will be a monthly operating cost of $2,025. It is anticipated that the operating cost for the remainder of 2006 will be $6,075. Commencing in January 2007, staff will be working to have the operating costs met or partially met by sponsors in exchange for an advertising presence on the Splash Page of the service. It was further explained that this item was not budgeted for in 2006, and therefore a budget adjustment would be required to implement. Michael Berinqer, Vice President; and Jamie Aqqen, Owner of L1GHTSPEED BOADBAND, Inc., handed out a letter to the Council to express their concern that they believed they had submitted a proposal to the Mayor's Office on April 23,2006, but that no response was ever received. Then, they only recently learned that their proposal was apparently not received by the Mayor, and therefore not considered by the City because the proposal was considered "late". They also submitted a report to show what their company was prepared to offer, which included "free" internet service with no maintenance or monitoring costs. Helen Miller asked Mr. Beriner and Mr. Aggen if they received a stamped-receipt from the Mayor's Office when they originally submitted their proposal, and if not, that should have been done. She also asked if the $48,250 was for a one time start-up cost or would this be on-going? Mr. Eley explained that the $48,250 was a one time amount for infrastructure costs; and the $2,025 would be a monthly occurring cost payable to a company for monitoring the usage and bandwidth to run the system. Laura Lyon, Finance Director, added that although the City is always interested in receiving proposals from interested parties, all proposals must be received at the same time and under the same criteria to allow an "even playfield" for all those wishing to participate. She further explained that the "door was not completely closed" because the contract tonight applies to only a small area of downtown, and if it is successful, other segments of the City will provide additional opportunities for L1GHTSPEED BOADBAND, Inc. and other companies to participate in the next RFP process. Mr. Shepherd asked if the wireless service currently provided by L1GHTSPEED BOADBAND, Inc. includes the waterfront. Mr. Aqqen stated yes, and added that they actually cover an area all the way to VVarren Avenue, and there are plans currently in place to expand even further. 06:04:52 M/S/C/U (Maupin/Shepherd) Move to approve a contract for provision of wireless internet service in the downtown area with VVave Broadband and authorize the Mayor to finalize and execute the agreement with substantially the same terms and conditions as contained in the proposal, and amend the 2006 Budget for Information Technology, authorizing additional expenditures of $54,325 and a corresponding General Fund Transfer. City Council Reg. Mtg. Minutes VVednesday,August2,2006 Page 3 of 4 6C - LOCAL AGENCY SPECIAL DETOUR AGREEMENT WITH THE WASHINGTON STATE DEPARTMENT OF TRANSPORTATION (WSDOT) FOR THE DOWNTOWN PEDESTRIAN/BTC ACCESS IMPROVEMENT PROJECT (#AB06-166): Phil Williams, Public VVorks & Utilities Director, summarized that the VVashington State Department of Transportation (VVSDOT) is planning for the construction of the Downtown Bremerton Pedestrian/BTC Access Improvement Project, which will require the temporary closure of Burwell Street (SR304) between VVarren Avenue and Pacific Avenue, and the detouring of SR304 onto other City streets. An agreement between VVSDOT and the City is required to identify and authorize the use of the detour route, and to address maintenance responsibilities. The agreement also identifies the improvements to the detour route that will be performed by the City, with reimbursement by the State. There were no comments from the public. 06:15:02 M/S/C/U (Arends/Robinson) Move to authorize the Mayor to finalize and execute the Local Agency Special Detour Agreement with VVashington State Department of Transportation for the Downtown Bremerton Pedestrian/BTC Access Improvement Project. Voted in favor of Motion: Priest, Shepherd, Robinson, Arends, Maupin, VVofford, Gehring, Brockus Voted opposed to Motion: McConnell Motion carried: 8-yes; 1-No 7 A - ORDINANCE NO. 4976. ADOPTING AMENDMENTS TO THE BREMERTON SHORELINE MASTER PROGRAM (#AB06-167): Andrea Spencer, Department of Community Development Planning Manager explained that the proposed ordinance makes amendments to the Bremerton Shoreline Master Program to ensure consistency with new Critical Areas Ordinance regulations adopted in March of 2006, and to correct clearly outdated or erroneous elements of the existing Shoreline Master Program. The proposed amendments remove an unworkable provision for view corridors in single family residential environments and improve public shoreline access with a documented network of public Shoreline Access points. Geoffrev Wentlandt, also with the Community Development Department, discussed each of the amendments being proposed in the ordinance; and further discussed five (5) additional amendments that were added by the City Council following the initial presentation at the Study Session on July 28, 2006. Helen Miller asked if the possibility of reducing buffers would depend on having enough money available to pay for a geo tech and a biologist; and if the proposed amendments to the length of docks and piers provided too much "power" to the discretion of the Director of Community Development? Mr. Wentlandt addressed the issue of buffers, explaining that for the first time, the Critical Areas Ordinance does allow for a buffer amount below the minimum; and described the proposed "buffer" zone added for docks and piers was to allow room for a transition. Larry Lober asked if the buffer area was limited to single family or residential use. Mr. Wentlandt clarified that all of the denser centers with mixed use and multi-family density will still have a view corridor requirement. Mr. GehrinQ hoped that a couple of incorrect items could eventually be corrected. 06:32:45 M/S/C/U (Maupin/Arends) Move to pass Ordinance No. 4976, amending sections to the Bremerton Shoreline Master Program, as amended.
