~.~EREAS, the Department of Highways of the State of Washington is desirous of
constructing an Access Road Project (Illahee - Brownsville Road) through the City
of Bremerton and is desirous of routing the traffic on said ~mprovement through
said City of Bremerton over
P~rry Avenue from its intersection with East llth Street northerly to its
intersection with the centerline of East 16th Street,
and cross~ng other certain intersecting streets and public thoroughfares, and,
WHEREAS, the Department of Highways of the State of Washington is desirous of
receiving Federal funds for the improvement of said Illahee - Brownsville Road,
and
WHEREAS, the Public Roads Administration of the Department of Agriculture of
the United States of Y~erica will not participate in the construction of said Illahee-
Brownsville Rosd until and unless the City of Bremerton will agree to refrain from
permitting encroachments upon the right of way of said above mentioned streets, and
until and unless the City of Bremerton will agree to refrain from passing ordinances
or laws affecting the free flow of traffic on said above mentioned streets or that
will give preference to local routes which intersect with said streets, other than
by the erection or installation of "slow" ~nd/or "caution" signs or signals, or that
will ~nureasonably hinder or delay traffic on said above mentioned streets, and until
~a~d unless the City of Bremerton will agree, by suitable ordinaDce, to s. dopt the
grades of the improvement as the grades of the city streets that are i~.volved and
agree to protect the Etate of W~shington against any and all claims for damages on
accotu~t of any changes of grades, and until and unless the City of Bremerton will
agree to maintain sa_id improvemenl within the corporate limits of the City of Bremerton
after the improvement has been completed;
N0~.~, THE. REFORE, BE IT RESOLVED by the ~.~ayor and Council of City of Bremerton
that for and in consideration of the Department of Highways of the State of
Washington and the Public Roads Administration of the Department of Agriculture
of the United States of America constructing said Illahee - Brownsville Road and
re,it!ns traffic on the same through the City of Bremerton over Perz~y Avenue from its
intersection with East llth Street northerly to its intersection with the centerline
of East 16th Street, and crossing other certain intersecting streets and public
thoroughfares, it hereby agrees with the Department of Highways of the State of
Washington and the P~blic Roads Administration of the Department of Agricult~re of
the United States of America that it will not, in the future, permit encroac!tments
on the right of way of the said above mentioned streets, nor will it pass any ord-
inances or laws affecting the free flow of traffic on said above mentioned streets
or that will give preference to local routes which intersect with said streets, other
than by the erection or installation of "slow" and/or "caution" signs o~~ signals, or
that will slow up, unreasonably hinder, or delay traffic on said above mentioned
streets, and that it will, by suitable ordinance, adopt the grades of the improve-
ment as the grades of the city streets that are involved, and hereby agrees to oro-
tect the State of Washington against any and all claims for damages account cha~ges
of grades, and hereby further agrees to msintain said improveme:~t within the corporate
limits of the City of Bremerton after this improvement has been completed.
PASSED the City Council of the City of Bremerton, Kitsap County, Washington,
this 3rd day of November A.D., 1943.
